    • Perfect, thanks Dave.   You're right, a whole dodo storm this has been. As sons of first-generation immigrant parents, whenever something like this happens the old man panics. There was a whole "appeal this now" because my dad paid for the parking as he was with the hirer at the time and he isn't as tech-savvy as my brother so he ended up doing what he did and because I don't live there anymore it came all the way down to this.  But yes, we'll do this SAR and see what comes of it.  Will keep posting here with the hopes that it may benefit someone in the future.  Thanks again, everyone.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My car was parked in town over night on Friday night, and was smashed into by someone in a stolen car. They've done a runner and not been found! I put a claim in with my insurance company Zurich on Saturday morning. When going through all my details this morning I think I have made a MASSIVE error in my policy...missed 3 points. I have 6 in total but think I have only put 3 of them on my policy. This was a genuine error by me and not done to defraud the insurance company...although i'm sure that's what everyone says. Both 3 points were issued in October 2008. Now that I have a claim in, is it too late for me to ring up the insurance company and come clean? I can't just leave it cos I have to send them my driving and they are obviously on that! I can't actually find anything that says how many points I have claimed for...and it wasn't until I found my driving licence that I realised my potential error! Does anyone have any suggestions? I really am panicing as we use the car to take out daughter to school 5 miles away!!

God!!!! Really don't know what to do. I really am stressing over this. As soon as I realised I was on the phone to the insurance company straight away...but thankfully they were closed!!! Really don't know what to do!!! They think I have 3 points...my licence say I have 6...I have to send them my licence....insurance companies don't like paying out.....not good!

Just send the copy licence in as requested and say nothing about point issues. Wait for them to contact you about it and sound shocked about the details on the policy being wrong. ...... I am sure gave the details correctly, sorry if they are not on there......

 

They should hopefully just take it as a genuine error and charge you the relevant extra premium.

That moves from a genuine mistake to something quite different, they probably are aware that folk might do that, so if they carry out a random check, will that put you in a better position - nope It's best to see what happens.

 

So blanking out the extra points on my licence when I scan it is not an option then!!!!! :wink:
