I am not sure if it has anything to do with the payday loan i took out last year as it has no information on my report where it is from nor any reference numbers!

 

The default is for £459 started 3/6/09 and defaulted on 22/09/2009 within 3 months of it starting?!!!! Don't they have 6 months time limit before they can place a default?

 

I am sure i have not received any Default Notice from them! What should i do?

 

I was so happy to almost sort my credit score within the next year and now this came up! What should i do now?

 

I am not sure who they bought the debt from as i took out a few payday loans last year!

 

Do i go the CCA route together with default removal? If so, could anyone provide me with a template letter?

Firstly, a default can be placed after just 1 missed payment.

 

This could well be a way of 'making' you contact them if you are not already receiving mail and/or 'phone calls.

 

I may be wrong but I am fairly sure that the CCA route will not help in these circumstances.

 

With regard to the amount, as you say it is 3 times what you owe, are you saying you may well know the amount it should be and therefore are actually aware of the loan to which this refers or am I misunderstanding.

 

If you are in a position to pay this in full, it could be an idea to write and offer payment in full with the proviso that all credit report information is removed.

 

I do not have much knowledge of Pay Day Loans, but from what I have read on CAG their interest rates are horrific.

If it is for a Payday Loan, chances are the over inflated amount is the late payment charges that have been added. Do you get any paperwork with this type of loan or is it all done online? If I were you, I would be finding their T's & C's and check the bit about charges. Also, check the part which may be listed as "How we handle your data" or something like that. You may find a bit in the small print that says that if they pass your details on to a 3rd party then the 3rd party can also add charges.

Payday Loans UK charge an eye opening 1737% APR, so there is a good chance that the amount on your file is the amount due for the period 3/6/09 to 22/9/09.

Thank you for the quick respond guys...

 

The original amount should not be any more than £200, the rest made up purely with charges and interest!

I am not in position to pay the amount in full! Not £459! I dont want to pay nothing more than what i originally owed! And even that, i can only pay in installments.

 

I have been on a sick leave since late July and i will not be able to go back to work for at least another month! I've been getting my wages as normal but from yesterday onwards all i will be getting is going to be SSP till i recover!

 

Why would CCA route not work? I mean surely the DCA doesnt have an agreement with me! My OC is the payday loan company! Does Mackenzie Hall have the permission to process and share my data with no signed agreement?

 

 

I DO NOT think i even have signed agreement even with the payday loan company (either QuickQuick, PaydayExpress or Wonga)

 

What steps should i take now? I need that default removed and will do whatever is necessary! Also; i have not received any Default Notice!..

If you applied online and it was last year, then the Agreement was almost certainly correctly administered. The CCA Laws were upgraded in 2006/7 to cover the 'loophole' and thus anything taken out after then should be watertight, and not unenforceable which is what a CCA request hopes to highlight.

 

I do understand you unfortunate position, but as I said previously, that is the nature of these 'pay day' type companies. Personally, I really do not know what advice to give, but there are others on this thread that may well be able to help much more than I.

Thank you HS... I understand the contract between me and the loans company is enforceable. However, does DCA also have the right to process this data? Surely, my agreement was with Payday Loans an not with Mackenzie!

 

I am very frustrated and confused! I understand the fact that i cannot disagree o Loan company and am willing to setup a payment plan with ONLY the PAYDAY company as long as they remove the unfair charges...

 

Does Mackenzie has the right to place default on my credit file?

 

I am sorry i may sound a bit hard headed but all i need is to get rid of the default on my credit report! And i am desperate for some help!

I cant pay the amount in full! I can only offer them £50 monthly payments and thats only if they take the chargess off!

 

What should i do? Is there any template letter i can work around with?

Im sorry guys but i figured out theres more into this story and wanted to keep you updated!

 

I took out a payday loan from Quick Quid for £300

Didnt pay the loan and now the debt is £459

Mackenzie Hall took over the debt and placed a DEFAULT on my credit file!

And NOW, Mackenzie transferred my file to Provident Finance which is chasing me!

 

I dont know what to do! I am so confused! Do i chase Quick Quid, Mackenzie or Provident Finance! Can provident finance place a default on my credit files as well?

 

Please help me out! I dont know what route to take and what to do!

As far as I am aware, they can only place 1 default on your file per debt, if Quickquid appear on your file it should say settled if mackenzie hall have registered a default.

 

Not too sure whether you can CCA payday loans or not - somebody will advise on that one., but if you can, then CCA Provident if they are chasing you now.

 

Be aware though, if it has been passed to Provident, I have read on here that they now have a DCA licence and get their normal door to door callers to visit you to either take a Provident loan out to clear the debt or make weekly payments to the collector.

Thank you HB, i sent the CCA to provident.

 

How bout the DEFAULT on my both credit reports with Equifax and Credit Expert?

 

How can i go about removing those defaults! They are both from Mackenzie!

 

I really need help removing those defaults!

They will only be removed once the debt is settled. The DCA has been assigned the account and they are allowed to register it.

 

You may find that Mackenzie Hall register the default as settled and then Provident will default it - unless Mackenzie Hall still have the account and are just using Provident to collect it.

 

Either way, you are stuck with the default.

As they've trashed your CF anyway you can dictate how much YOU can afford. Tell them to like it or lump it. They would never issue court proceedings because judges DO NOT like companies such as these because of the extortionate interest they charge to the most needy in society. They're all legalised loan sharks!

Can they still register a Default even if they dont have the original CCA? I have not made any agreement with Mackenzie, my original agreement was with Quick Quid!

 

And i HAVE NOT received any DEFAULT letter! Does that still mean they can issue default?

 

Arent they supposed to send me a default letter before placing default on my credit file? Since i havent received the such letter, am i not allowed to ask them to remove it? This has happened to many others before! Why does it not apply to this case? I am confused!

Does Mackenzie NOT NEED an agreement with me to share my data with CRAs? Surly, my agreement wasnt with them and i have not given them any permission to share my data! So how do they share it without my permission? Isnt that illegal?

Is there a way i can stop them from doing so and ask them to remove it??

Hi

Quick bit of clarification.

When you defaulted QuickQuid would have placed the default. When the debt was sold, the DCA would have replaced QuickQuid's name with their own. The date remains the same. When you took out the loan, you agreed to data sharing and that includes DCA's.

 

You will only get the default removed in a negotiated settlement. They are under no obligation to remove it so long as it is accurate.

They do not have to prove that a default notice was sent-only that they issued one and that should be on the customer notes on the system. To find out if a DN was issued, you would need to SAR the original creditor

Quick Quid never placed a default on my credit file nor send me any letters stating they were going to transfer my debt to DCA!

 

I am in no state of paying the debt in full UNTIL January! I can pay it in full in January, however, i am scared they might place a CCJ on my credit files till than!

 

Could anyone help me writing a letter asking for default removal on a conditional aggrement?

 

For example, i can pay it in full in January, only if they remove it... Or i wil lnever pay it since they trashed my files already (as babybear said)

 

I wont be paying a penny unless they remove the default... Any suggestions?

 

PS. Sorry if i m being a headache, but i tried so hard clearing me credit files and now this came in! That means another 6 years of no credit! I seriously cannot go through with this!
