It is a pity that you wrote to PE  which would be perfectly normal, except with crooks like PE  as you may have revealed you were the driver. You have lost the protection of POF A but it is not a fatal. Please do not even think of paying a penny. The amount may go higher in the short term but when the poor dears do not hear from you they get worried ( because they think to won't pay) do they start sending begging letters and reduce the amount owed.I One of the Site Team will be along shortly and give you a template to fill in which helps us to give you the best advice should they not give up.     • HI   You took possession of the Property in 2010 but when did you end the Tenancy Agreement?   Did you give them the required Notice to end your Tenancy?   You mention you paid a Deposit in 2010, was this returned when you ended the Tenancy?   You need to know exactly what they are claiming money owed is for and surprised that solicitors letter does not mention this.   Send the Landlord a Subject Access Request (SAR) asking for 'ALL DATA'  (ensure to send a copy to the Solicitor acting for them as well.

    • Hi   Sorry for the delay in getting back to you don't worry we have not forgot you.   So they have destroyed ALL DATA personal to you as you did not take the Property. (really they have put there foot in it)   If they hold no personal data then they have NO evidence of what was agreed to with your Holding Deposit and the refusal to return it.   Now if it was me I would let them drop themselves in it even further by responding to there SAR response.   Thank you for your SAR Response dated XX/XX/2019   Due to this response I require clarification of the following:   1. Have you followed the Data Protection Act 2018 & General Data Protection Regulations on Destroying My Personal Data?   2. If you have Destroyed All My Personal Data then what documentation do you hold that I have signed/agreed to the Holding Deposit being Non-Refundable and to provide copies of this documentation.   3. I require a copy of your Policy on Holding Deposits   Please bear in mind the above is what I would do.   I do think it is looking like you may have to go down the court route (make sure and have a good read of that link I previously gave you to the Tenants Fee Act).
    • HI   Firstly the parking in front of your drive, do you have a pavement with a Drop Kerb in front of your property to access your driveway, if so are they infringing on the Drop Kerb? (note your can ask the council to to paint a white line with lines at the end on the road in front of the drop kerb please note there may be a cost from the council to do so)   As for the CCTV look at this ICO link: https://ico.org.uk/your-data-matters/domestic-cctv-systems-guidance-for-people-using-cctv/   Due to the new DPA/GDPR if you have CCTV on your Property and it views outside of that Properties Bounderies they then need to register as a Data Controller with the ICO.   So I would make a Formal Complaint in writing to the Councils Data Controller, ICO (specifically asking if this individual is Registered with them as a Data Controller) & Police, you need to keep a good paper trail of this individuals actions.   I hope this individual knows the Law on Harassment as from your thread that is the impression I get is no matter what you do they will find something else to complaint about.

Home Shopping Direct companies have agreed reduced payments but are still charging interest.

 

Next has stopped interest and agreed reduced monthly payments.

 

Studio have agreed the £10 a month

 

Think when I start maternity leave I will write again enclosing an I&E stating I can only afford £10 a week per creditor

I notice one of the Home Shopping Directs monthly payments is £42.00, of which £26.00 is the service charge, so only paying off £16.00 a month of the outstanding balance!! This could take forever! I presume the other Home Shopping Direct accounts are charging similar percentages!

I have set up payment arrangements with my catalogue companies explaining that I will be going on maternity leave and won't be able to pay the full monthly payments due once my maternity leave starts. By the time maternity leave starts I would have been in these arrangements for 5/6 months.

 

Once I am on maternity leave I won't even be able to meet these reduced payments, so was going to write to the closer to the time with an I&E showing I can basically afford £5 / £10 a week per creditor. Is this the right way to go about this?

 

Just planing ahead, thought I would do the letters ready to post closer to the time.

Next have come back and declined my offer, but said they can accept £29.00 per month and will freeze interest and charges.

Have agreed to Next payment for next three months.

 

The other creditors I e-mailed (JD Williams companies) with my I&E form, they never answered, chased up, they have e-mailed back today asking if I can call them where an account manager will try to help, they are unable to accept further e-mails regarding my account

Received letter from Lowells regarding a debt they've purchased from Redcats Finance of £127.92. In the letter they enclose copy catalogue statements.

 

Should I CCA request? Or hold my hands up to this & pay?

can you give us more details? one point if I sent you a letter saying pay me £127.92 and pulled together some statements would you pay me??? if its no why would you pay them?

Catalogue debt from 2007. Occurred at my parents address, but seems they've tracked me down to new address (well i've been here 3 years)

Received a letter from Lowell basicaly saying that the balance realtes to an Empire Stores account opened on 8th April 2007.

 

Notice of assignment was sent in writing on 14th June 2010.

 

Statements were sent on 15th July 2011

 

They have requested copy of agreement from original creditor & they are still awaiting receipt of it

Received letter from Lowell, saying they are now entitled to receive payment of £127.92 and enclose a copy of the agreement as requested.

 

Enclosed is a credit agreement but I have not signed it

I have noticed from your postings history that you tend to set up a new thread each time you receive a batch of communications. If you want to find an old thread, if you click on your CAG user name, you will find all your previous posts. In your post history, you will find that you have previously mentioned this debt. Also in your separate Lowell/Three thread, you had mentioned the Three debt back in 2009 in a previous thread.

 

I don't know whether it helps others on this site, but I prefer to see the history of debt collection under one thread, so you see what has happened with a debt. If the information is spread out on many different threads, it can be a little confusing and can cause duplication or worse wrong advice being offered.

 

In regard to the query on this thread about the CCA not being signed, I am not sure this is a problem in terms of them taking you to court, given the date you took out the account. I think the changes to the Consumer Credit Act that came into force just before you took out the account, mean that they just need to evidence that the debt exists. BUT given the amount of the debt, perhaps this is not a priority to them, as even if they took it to court, it would probably not be economical for them to do so.
