Hello, I have been taken to court by my daughters private school for non payment of fees (total £7000), My ex husband has paid these fees for the last 14 years. I obtained a court order when we divorced 13 years ago for him to pay me a set amount each month ( which was to include money for fees). Insted of paying all of this money to me directly he paid the school directly and gave me the remainder. last year he lost his highly paid job and hasn't bothered to get another and stopped paying both myself and the school. I have a telephone hearing with the judge next week as the court have really messed up on the documents ( hey said i hadn't returned any defence etc but then admitted they had received it but had misplaced it. They also held a hearing before the date the papers were due to be returned and entered a judgemnet by default against me for non return of defence. They apologised and said this would be removed immediately then sent a further letter asking for a telephone hearing. The school have set up a charge against my ex's house for the full amount and he has told them it is his debt but the school say because i signed a form 14 years ago I am liable for half of the fees. I have never earned enough to be able to afford the fees, have never paid the fees and don't own my home. i would appreciate any advice anyone can give me regarding the telephone hearing. I have no other debt, have a good credit score and have lost a lot of money as my ex no longer pays me and has broken original court order .

Hi

Welcome to The Consumer Action Group.

I am just letting you know that as you haven't had any replies to your post yet, it might be better if you post your message again in an appropriate sub-forum. You will get lots of help there.

Also take some time to read around the forum and get used to the layout. It is a big forum and takes a lot of getting used to.

Once you start to find your way, you will soon realise that it is fairly easy to get round and to get the help you need.

It can be bit confusing at first.

Please be advised that my time will be limited for the next few weeks. Thanks for your understanding.
