How do you work out the daily interest rate on the charges?

 

 

(I'm really sorry for the stupid questions, but I'm quite worked up and I'm sure i'm doing this wrong)

I gather you are talking about the s.69 8% interest.

 

The claim is for the total of charges applied to your account, as well as the 8% applied to each charge from the date the charge was levied.

 

Your daily rate (from the date you raise the claim until the date of settlement) is the daily equivalent of 8% of the total of the above. For example, if your claim total (including interest) is £1,000, and the daily rate of interest is 0.022%, you would be claiming interest at a daily rate of 22p a day, and this does need to be expressed in pence/day rather than as a percentage.

hi there,

 

i have claimed through a n1 at the county court. i thought this was very easy.

also when you claim you need to fill in a spreadsheet. if you look below my signiture there is a link for the interest spreadsheet.

 

i think that people are having to send the schedule of charges seperatley. (spreadsheet)

 

when i filled in my n1 at court i attached 3 copies of my spreadsheet with it. one for me one for the judge and one for the bank.

 

also if you claim on a n1 at county court there is also more space to use in the particulars of the claim.

Thank you, so on my claim of 3,501.64 my daily rate of interest is 77 pence per day on top of the 3501.64? (charges come to 3,093.50 and interest comes to £408.14) Is that applied form the day you issue the claim at MCOL? Do I need to include this in my MCOL claim? (the fact that I shall be claiming another 77 pence per day)

Hi Lisa, I have worked out the interest on that spreadsheet before, however i just want to get the claim bit right for the MCOL. Its so stressful (to me anyway! I'm just thick!)

Yes - the wording should be something like:

 

The claimant claims £3,039.50, plus £408.14 in interest pursuant to s.69 County Courts Act 1984. The claimant also claims interest from the date of claim until the date of settlement at the rate of 77p per day...

How does this sound?

 

 

I have a contract with the defendant bank which is conducted on their standard terms and conditions. I am claiming the return of money taken by the defendant in the way of charges over the last 6 years plus the interest they have levied on those charges. The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2(1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. The claimant claims £3,039.50, plus £408.14 in interest pursuant to s.69 County Courts Act 1984. The claimant also claims interest from the date of claim until the date of settlement at the rate of 77p per day.

Sorry! Will leave you alone soon, just want to be extra certain that I am doing the correctly. The 77p per day will be added after the claim has been resolved, yes? I have declared the 77p per day in the bit that I can write in, I don't have to put it anywhere else do I?

Well, I have had a letter from the dear Mr Langdale offering me 2k on 3k worth of charges in full and final yadda yadda yadda. Obviously I'm going to reject this, I just wanted to know should I accept and say that I will be going on to claim the rest, or should I reject and inform them tha it is now in the hands of the courts?

bump!

 

 

 

Just wondering if I need to send the letter back to HSBC as it is now in the hands of the courts? HSBC acknowledged my claim on the 12th September, the same as the date on my letter with the offer on. Should I write saying I am not accepting ANY of the offer as it has now gone to court, or should I write back saying I will accept it as part, but will be persuing the rest including the 8%?
