    • Well tbh that’s good news and something she can find out for herself.  She has no intention if peace.  I’m going to ask the thread stays open a little longer.   It seems she had not learned that I am just not the one!!!!  plus I have received new medical info from my vet today.   To remain within agreement, I need to generally ask for advice re:  If new medical information for the pup became apparent now- post agreement signing, that added proof a second genetic disease (tested for in those initial tests in the first case but relayed incorrectly to me then ), does it give me grounds for asking a court to unseal the deed so I can pursue this new info….. if she persists in being a pain ? If generally speaking, a first case was a cardiac issue that can be argued as both genetic and congenital until a genetic test is done and then a second absolute genetic only disease was then discovered, is that deemed a new case or grounds for unsealing? Make sense ?   This disease is only ever genetic!!!!  Rather more damning and indisputable proof of genetic disease breeding with no screening yk prevent.   The vet report showing this was uploaded in the original N1 pack.  Somehow rekeyed as normal when I was called with the results.  A vet visit today shows they were not normal and every symptom he has had reported in all reports uploaded from day one are related to the disease.

    • I think you have the supremacy of contract as it allows you to park in designated areas. I would argue that there being parking enforcement there clearly means its to be used as parking and as such you can use it under your lease. Only need to worry if they ever follow through with a letter of claim and a claimform though

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi-ya !

hope some1 can hlp me pls ! dunno where 2 start !

 

i thought i was waiting for 100% confermation place ,time ,and date ov my tribunal hearing instead ov them just guessin it would b some time in oct 2010 !

 

i am @ the stage ov pulling hair out , i failed dwp medical ,i have appealed , and basicaly thought i was waiting on date for hearing !!!

 

on friday just gone ! i got a nice letter from dwp saying " that they had looked @ all the evidance an as a result they have changed there decision and that they would not be sending any details ov my appeal to tribunal services as the decision had been changed in my favour !!!

 

so i phoned dwp esa straight away ! only to be told that they have no idea wot i woz on about as there systems an tribunals for that matter ! still sayin i hav an appeal soon but they dont know date !!!

 

you would think after me getting letter dwp would have something on my records ! futher more guy from dwp said send him letter even thou ,i woz now speakin 2 office that sent me it !!!

 

its driving me madder than i already am ! pls pls help some1 ! : ( !

Your claim may be clerical, in which case it would not be on the computer system, or it may be that the person on the enquiry line is not accessing the correct part of the computer system. I'd ring again and ask them to arrange for someone from ESA Appeals Section to call you back.

 

Don't send the letter back to them. If they insist on seeing it, send them a copy.

thx 4 all your help ,erika they want me 2 send photo copy ,now waitin on reply slip 2 send it back in ! woz on ib 2003-2005 , i find all this esa very badly put together ,basicaly 2 show wider public that there cuttin sick benefits , i'd say they hav done a good job , last pathways soon even they are sayin the whole thing should be changed as every1 fails med !

 

also wot do you mean when u say my claim might b clerical , thx 4 your help ,so far u hav helped more than all ov em ! X

A clerical claim is basically a claim which cannot be input to the computer system therefore everything to do with your claim is done manually and held in a paper file.

My advice is based on my opinion, my experience and my education. I do not profess to be an expert in any given field. i will b phonin them th mora an asking for "ESA Appeals Section" 2 call me back , also i contacted clerks @ tribunal services an there system is sayin that am waitin on date ov hearin !

however they also told me that , if my letter from dwp is true , dwp should send tribunal services a t-??? something or other form an dwp r constantly sendin people notice 1st then tribunal services !

dunno ! its doin ma heed in thou !!!

My guess (I used to process ESA) is that the appeals section has done a reconsideration and this has gone in your favour. This means that there is no need for the appeal to proceed. The appeals section has sent you a letter about this and updated a computer system called DMacr (pronounced "D-Maker").

 

The next stage is that they should inform the processors who will update the system that actually makes payments, known as JSAPS ("Jay Saps"). This can take some time, a week or so perhaps, and it looks like it hasn't happened yet. Sadly, the two systems don't communicate automatically - actual human intervention is needed to make this happen. The staff who answer the phones won't normally have access to DMacr so they likely won't know about the reconsideration in your favour.

 

So yes, calling up and asking for a callback from the appeals section is indeed the best way to handle this. You want to know, primarily:

 

 

  • has there been a reconsideration in your favour?
  • if so, has the Claims Maintenance (sometimes called "Load") section been informed of this?
  • if yes, when?
  • if not, politely ask them when the hell they were planning to do so

I stress again that this is a guess, but I did encounter similar situations reasonably often.

thx alot for your help , i hope wot u r saying is true ,as it makes the most sence ov a crazy situation ,people would not know ov these things happenin in the back ground out ov sight ,i woz under the impretion that dwp appeal section only look @ my appeal letter 1 time and that if they cant change it ,then they send stuff 2 tribunals , as has happened 2 me , i thought i woz waiting on appeal hearing date ! so i will b phonin them soon !!!

 

will let all u guyz know how i get on !

here is the latest on my mysterious letter ! i phoned dwp reguarding my letter and was told everythings still the same and that my reply slip to send it to them is in post still !!!

 

i asked nicely if i could have a call back from "appeal section" and was told a "dession maker" would call me back ! a few hrs later , i found my self speaking to a "dession maker" and told her everything i know about letter ! to my horror she is standing by dwp and saying they have no idea about this letter no trace ov it on any systems ,and she has set me up with job centre appointment to fax it over to her !

 

so guyz i dont know wot to think now ......................: ( ( !!!

This is indeed strange. Definitely, as Erika said, make sure you take that letter away with you when you leave your Jobcentre appointment. I'm not sure I can say much more at this point, but be sure to let us know what they say when they receive the fax.

hi guyz !

here s the latest ,sorry its a little boring , i had my last pathways just gone , my advisor very nicley faxed "dessin-maker" my letter after reading it her self ,she also thinks its very strange they no nothing about my letter !

 

still no phone call from dwp , i faxed letter last thursday , the next time i will call them is coming soon and i will be with c-a-b advisor , so guyz will let u know wot happens !!!

well finaly dession maker has called with letter i faxed 2 her , she has called a few time now !

she is still saying that letter is a mistake althou some pts r true ,like my name address ni number an the fact i have only 1 appeal all true !
