    • Hi Everyone, hope you are all keeping well in this strange new era.   On the 17th Sept, my friend booked a delivery to send a parcel to the USA, a vintage sewing machine. The collection and delivery was booked through MyParcelDeliver.Com, and UPS was the chosen courier. They collected it about four days later.   He paid for additional insurance along with the transportation of the item, to the tune of £128.75.   He packaged the parcel very well, packed with bubble wrap and paper and also styrofoam so that the sewing machine was safe in the box. He placed some plastic wrap over this, and he then sealed the box with tape. He videoed this for the buyer, so she could see how well he had packed the item because they were both concerned about the package being well protected.   The item arrived in the USA a few days later. The buyer instantly notified my friend that the parcel packaging was damaged, showing stress from water and general mishandling, and the item was also damaged in various parts, mainly the casing and the base.   He complained to MyParcelDelivery.Com on the1st October, they responded with 'You need to contact UPS...', which he did and also the buyer contacted them and got a response on the 2nd October.   UPS informed the buyer they would like to come and take a look at the packaging and the item, and this is the last she heard from them, she has called them several times, and always they say someone will call tomorrow and no one calls. She called my friend to ask if he could call them too and chase them up, he is Italian, and though he speaks English generally well, he asked me to talk with them on his behalf because he felt they were not listening to him or that he was missing something.   I spoke with them on the 26th October, they said they had sent my friend an email about this, we checked all of his emails, junk/spam too. There is nothing in there, I asked them to resend it, but nothing has appeared despite them saying they have sent it, we know they have the correct email address because they sent a message on the 2nd confirming they are looking into the claim of a damaged package, they also said they were planning on calling the seller 'again' on the 27th, which of course never happened, which she confirmed with me on the evening of the 27th.   Now it would seem to me that MyParcelDelivery is trying to say it has nothing to do with them, despite the booking being made through them, UPS US are pretending they are doing something but have so far done nothing, and we have heard Zilch from UPS UK.   I would like, if possible, some guidance on how to go about getting this resolved because this is just not right, the agent/courier have had their money, but the seller and buyer have been the victims of poor service and damaged goods.   If anyone could point us in the right direction on how to tackle this and get some redress for this, then I would be most grateful.   Thanks and kind regards   Mr B                 pox.pdf

    • Hi. As you can probably presume by the time this has been posted, I am annoyed. Long story cut short is we bought a new build, got a professional snagging company to come in and make a list of things that needed doing and am now still in the process of liaising with painters / electricans, etc. There has been significant disruption with arranging to be in to help guide the various workmen, etc, let alone the complexities of Covid to deal with as well as having two small children. Tonight we were up until quite late having to prepare things for a painter to come tomorrow to fix all the awful painting and marks on walls / poor finishes, etc. This has (and has had over the last few weeks) had a knock on effect with being tired, work being affected, let alone sooooo much time wasted on discussing the various elements with the developer (who hasn't argued with any of the painting, poor electrics, etc that has to be done). My question is has anyone ever claimed redress for all the wasted hours that have to be spent on doing things like this because a developer rushed to get a house ready on time?

    • I came across this discussion recently and just wanted to give my experience of A Shade Greener that may help others regarding their boiler finance agreement.
       
      We had a 10yr  finance contract for a boiler fitted July 2015.
       
      After a summer of discontent with ASG I discovered that if you have paid HALF the agreement or more you can legally return the boiler to them at no cost to yourself. I've just returned mine the feeling is liberating.
       
      It all started mid summer during lockdown when they refused to service our boiler because we didn't have a loft ladder or flooring installed despite the fact AS installed the boiler. and had previosuly serviced it without issue for 4yrs. After consulting with an independent installer I was informed that if this was the case then ASG had breached building regulations,  this was duly reported to Gas Safe to investigate and even then ASG refused to accept blame and repeatedly said it was my problem. Anyway Gas Safe found them in breach of building regs and a compromise was reached.
       
      A month later and ASG attended to service our boiler but in the process left the boiler unusuable as it kept losing pressure not to mention they had damaged the filling loop in the process which they said was my responsibilty not theres and would charge me to repair, so generous of them! Soon after reporting the fault I got a letter stating it was time we arranged a powerflush on our heating system which they make you do after 5 years even though there's nothing in the contract that states this. Coincidence?
       
      After a few heated exchanges with ASG (pardon the pun) I decided to pull the plug and cancel our agreement.
       
      The boiler was removed and replaced by a reputable installer,  and the old boiler was returned to ASG thus ending our contract with them. What's mad is I saved in excess of £1000 in the long run and got a new boiler with a brand new 12yr warranty. 
       
      You only have to look at TrustPilot to get an idea of what this company is like.

    • Dazza a few months ago I discovered a good friend of mine who had ten debts with cards and catalogues which he was slavishly paying off at detriment to his own family quality of life, and I mean hardship, not just absence of second holidays or flat screen TV's.
       
      I wrote to all his creditors asking for supporting documents and not one could provide any material that would allow them to enforce the debt.
       
      As a result he stopped paying and they have been unable to do anything, one even admitted it was unenforceable.
       
      If circumstances have got to the point where you are finding it unmanageable you must ask yourself why you feel the need to pay.  I guarantee you that these companies have built bad debt into their business model and no one over there is losing any sleep over your debt to them!  They will see you as a victim and cash cow and they will be reluctant to discuss final offers, only ways to keep you paying with threats of court action or seizing your assets if you have any.
       
      They are not your friends and you owe them no loyalty or moral duty, that must remain only for yourself and your family.
       
      If it was me I would send them all a CCA request.   I would bet that not one will provide the correct response and you can quite legally stop paying them until such time as they do provide a response.   Even when they do you should check back here as they mostly send dodgy photo copies or generic rubbish that has no connection with your supposed debt.
       
      The money you are paying them should, as far as you are able, be put to a savings account for yourself and as a means of paying of one of these fleecers should they ever manage to get to to the point of a successful court judgement.  After six years they will not be able to start court action and that money will then become yours.
       
      They will of course pursue you for the funds and pass your file around various departments of their business and out to third parties.
       
      Your response is that you should treat it as a hobby.  I have numerous files of correspondence each faithfully organised showing the various letters from different DCA;s , solicitors etc with a mix of threats, inducements and offers.   It is like my stamp collection and I show it to anyone who is interested!

i Ended up without any sleep at all last night but i so wanted to make this a day that i could home and say "yes i done it" well i went , the drive up i layed down with a pillow in the back (as my partner died in accident dont like in the car) when we got there my partner went in and said i was there , by this time i was already panicking , as soon as i seen that the medical center was in the middle of the town !! that was it as i was getting out of the car (for people who have what i have u know the feeling) that creeping dizziness and feeling sick (anxiety at its worst) ,

well to cut it short as soon as i seen the office and i could see there were 2 people there i just stood my the doorway (i had a baseball cap on to avoid me getting further paranoya), we were only there 5mins and my temper started to go (its like another person inside of you rears its ugly head and the other half of me gets angry cos of the feeling of powerless i have over it),and its funny because you hope there wont be any "scenes or drama" yet in the end its you that creates them !!

Im so embarrassed

The ladies at the desk come over (by this time my husband said i was picking at the wall cos i felt i was losing it the panic attack getting stronger and me being weaker) i was now in the hallway and my husband said hed never seen 2 women panic like they did cos they went to come over to comfort me and i firmly started saying to my husband "IM GOING HOME NOW"

i feel so awful cos these 2 ladies were lovelly and there i go freaking them out ,

One of the ladies told my husband "look you take her home ill put on the system that she have a home visit"

now in all fairness i would NEVER have said that would have happened , i really thought well my money defo stopped ,

i cried all the way home because i wanted to be travelling home with that warm feeling as in proud cos yes i had done something i said i couldnt and i failed :(

My heart goes out to you i understand what you have put yourself through.

But see a positive you actually got in the car and arrived at the medical centre so you have actually achieved something.Be proud of that if you can.

I agree you got there be proud of that, they can now sort you a home visit. There are enough people like us out there for them to have no excuse to understand the need for home visits when ill with anxiety in such a way xxxx

Doesn't sound like you failed to me! You left the house, you went in a car, you walked to the building, you stood in the doorway. They've agreed to a home visit.

 

I think you did really, really well today............for goodness sake.......you faced so many fears. Round of applause for that woman :)

Oh banksarggg, as stated by catkin, loop and tina above, you did many things today that you should be proud of!

 

Now put your feet up and get some sleep as you must be shattered. If there is anything I can do to help you prepare for the home visit, you just have to ask. I am new to this site so am unsure how you go about emailing me. I do have some experience of these visits and other experience which might be of assistance to you xx

ive got my new appointment and its tomorrow although worried but i intend on seeing my doctor for strong anti anxiety pills before i go , im so determined to do it , ive had a LOT of grief and im losing more people through the way i am and i cant take it anymore and i just dont have the fight in me to do the home visit thing

i fully intend (i pray i do go through with it) im going to wait in my car and NOT in the doorway and have my partner go inside and he can let me know when im being called cos i am NOT waiting in there for my anxiety to sky rocket , if i make it in the doctors room my husband will be asking if he specialises in mental health and anxiety etc (been told to ask) and also if they wouldnt mind if i taped the conversation and as my husband said he will say it like this :

 

"is it ok to tape the conversation as i was advised to ask as there have been many complaints about things being put differently and i dont want my partner to go through all this agian etc"

 

in other words dont even think about doing it , and i hope the report is fair

 

a HUGE thank you EVERYONE u guys on here are such an asset to have in anyones life

With regard to recording the medical you are supposed to ask their permission in writing.They would then insist on proper recording equipment like they use in the police and a sound engineer.

I know of people who have recorded it but haven't told the doctor that they are.

If your husband is going in with you he can take notes for you.

Just do it & don't tell them. The ATOS policy on recording of medicals is just that their policy and has no basis in law.

 

The only argument on covertly recorded medicals is what you can legally do with the recording afterwards and whether it will be accepted as evidence by a tribunal.

 

There's a 5 page thread in the NHS section on recording medicals if you need more info.

 

Since you will be taking notes I'd suggest transcribing the recording and submitting that if needed.

 

Remember if you ask to record on the day the most likely outcome will be for them to stop the assessment there and then. With all the problems that will bring.

I agree with speedfreek, don't tell them. Someone else on this thread had their 'medical' stopped and I forget where it went from there, but it was lengthy. Certainly for an Employment tribunal, you can use a transcript as evidence, just not the recording itself.

 

I've also followed the NHS thread, it's by nolegion. Interesting reading.

Just a quickie that may help others, you mention about taking somebody into the medical with you. When I had my medical with ATOS, I asked if it was possible if my wife could come in with me. I was told that it wasn't necessary and may in fact be a disrupting influence to have her in there. So she stayed in the waiting room.

I felt that they were almost insisting that she didn't come in.

Why is it so important for you to mention it?

By the way I failed(Jan2010)and received 0 points. Have appealed but have cancelled the appeal because it is taking too long to be heard (April 2011). I am hoping to put in a new claim, but that is another story.

There is nothing legally stopping you having someone there :whoo:

 

The only reason why they might complain is if something isn't right with them i.e. it's a shonky medical with someone actively there to fail you to improve their stats to meet failure targets.

 

You have a right to be there with them no guff nothing it is your right! :lol:

I am sorry to hear of your experience.

As speedfreaK says you are allowed somebody in with you.My mum came in with me and ended up answering most of the questions as i was in no state to.

The doctor even said don't worry mum can answer for you as it is all too much for you.

I was lucky i had a very understanding doctor.

well im so happy to say i did it :)

well half of it .......the ladies on the front desk were extremly helpful (id written a note to them and sent it to the office after my last visit to apoligise about my behavoir)

They let my hubby wait in the waiting room he then came and got me out of the car and i went straight into see the doctor (she also told my husband before he got me "ive managed to get her to see the other doctor" whatever that meant)but as my husband said "she made sure u seen a tidy doctor" and he was lovelly , i did all these exercises (in my mind) of putting focus on other things to stop me from putting emphasis on my anxiety plus i had a new anxiety pills off my doctor to go as he was more than willing to do a note to request a home visit but it was something i wanted to do ,

and i was ok (still had heart pounding etc) but half way through i looked at my husband and he knew i jumped up and said "i HAVE to go" he didnt make no fuss (hes hardly asked anything)

in fact he went straight to the door and said to my husband "she wants to go does she dont worry its ok" (i think the receptionsits and my behavoir last time they must have discussed my last visit because you could swear this old man (doctor) was scared of me (which i was and am upset at because im ashamed of my behavoir last time)

still though i dont know wether they will fail me for not sitting through it all (my hubby taped it on his mobile phone just to see if the doctor did say anything different as ive read a lot of posts saying they do)

how long does it take to find out if you have passed or failed ?

May I please settle the question re. WCA and a witness, adviser or carer being present.

In parliament this question was raised and the response was that the Law says YES, if ATOSh say otherwise, then go through the procedure of firstly complaining to ATOS, see here how to do it and keep evidence, then you can have a go at the DWP after exhausting the set procedure - if you're still alive!

I'm not a qualified welfare rights adviser, but I'm planning on becoming one. I've been running a Crisis Loan campaign and help since Jan 2007 . See my annotations c/o "theyworkforyou". I'm also currently interested by the recent DWP Medical Services reform and the effect this is having on valid claims, seriously - someone needs to be keeping a suicide count.

hi

sorry everyone another problem with esa !!

my husband and i havent lived together in 2 years even though hes here daily , we were and are not a couple , we get on great and know each other well , so after we had a talk we realised it was better if he moved in ,

so i told HB and the DWP (hes been on incapacity for many ,many years) well i recieved a letter saying "esa has suspended due to a change in your circumstances please fill in the form etc etc"

which i did ,

then a letter off the HB saying they were no longer paying rent because of " change in your circumstances please fill in the form etc etc" i filled them in

on the day of my medical (while those who have heard what it is like) i was kept on the phone for over an hour (making me late for my medical) i told her i had a medical and was already stressed out , this was for a crisis loan because my money was due that day and they said they couldnt pay me till they,d had the forms etc

Now on the phone this lady was awful after i said i was down as agraphobic she said "well because you have had a crisis loan twice already in the last year you might need to go to your local office for an interview" i said "the only reason i have had to have one is because the DWP keep stopping my money on the due date"

i also said to her straight "why did you just say that AFTER me saying i was "Agrophobic" she went on to ridicule me more by saying "do you have any other means of money" !!!! i told her "if i did i would,nt be on the phone with you" !!

in the end (and through tears) i put the phone down on her

she rang back saying "we were cut off sorry" and then was a bit more polite

 

well anyway she kept on saying that i HAD to claim for my husband and i dont want to , she told me i dont have a choice

is she right do i have to now claim for my husband ? because hes moved in ? i wish they would hurry and sort it out and pay me the monies due to me

any help gladly appreciated

I don't know the answer but I do sympathize with you. My doctor has advised me to not visit these websites with the benefits horror stories because it raises my anxiety level too much.

 

I am in my own benefits horror story and it's not going away any time soon.

 

You probably do have to claim for him but don't take my word for it.

Thanks for that. It's a bit late for us now - all this happened in Jan this year. I never knew you could complain about it, we just took it that as he was the doctor and those were the rules that he laid down.

If there is another time that I have to claim which my be sooner than I had hoped as I cannot really cope with JSA, having to look for jobs all of the time when I should be taking it easy, as per my consultant's instructions I will remember your comments.

Yes I have had a lot of help but ultimately I expect to win a battle but lose the war.

 

I expect to win my appeal for IB only to be migrated to ESA and not qualify for it; depression and sciatica are not reasons to be unemployed under ESA rules.

 

So it will be JSA for me, and pretending I could work, when actually I would not last more than a day or two in most workplace situations.

It's extremely unlikely that you will be able to argue successfully that you live with your husband but aren't a couple. You could read through these guidelines (PDF file) for DWP Decision Makers, but my understanding is that they apply to unmarried couples who live together. When I worked there, I never encountered a situation where a man and woman who were married lived together but asserted they were not a couple. I guess maybe the rules could be applied in the case of a recent marriage breakup if one person needs to save money for a deposit on a new flat or the like.

 

I'm posting this mainly to bump your thread on this forum - I was an ESA processor but I'm not a Welfare Rights Adviser, and they'd be your best chance if you want to fight this particular battle. CAB or your local council may provide such a service.
