Hi all,

 

Hope someone can help...

 

Had a payday loan from quickquid that I didn't pay. I was getting at least 3 collection calls a day and I got sick of it so I told them I wanted to hear from them in writing only. They didn't acknowledge this and I got a call from a woman later that day, she was only to happy to demand the full balance and tell me what I owed without going through any data protection. I made a complaint and requested a copy of the call.

 

Got a long email back from their legal department saying they have followed all of the lawful guidelines, I was told it was being mailed from the US and would take 6 weeks, I still haven't received this - it was nearly 9 months ago.

 

I checked my credit report on callcredit and the b******s have put a default on there without giving me any notice.

 

How do I get the default removed, do you think I should take this further and complain to the ICO saying my data has been compromised?

Hi Nathan, you have email and this would have been a better and more responsive approach as letters can take an age. The default has come about because of this and it would have been better to have kept communication alive in a sense of your offers to repay this debt. The only way to get this removed now is to come to the table with a repayment schedule insitsting that they remove this default from your file. Have you paid anything towards this debt to date ? When did this happen ?

QQ are a nightmare for refusing payment plans that are over 3 months in duration. I play email ping pong with them every week and still no luck. If they have issued a default without notifying you and it ever gets to CCJ stage you can get the claim thrown out on that technicality I believe (robjam is your man for that I think).

Hi,

 

Took it out in december 2009 and complained in January, haven't heard from them since (at least the collection calls stopped). I haven't paid anything yet, or made any payment plans.

 

Surely the default is invalid because they haven't notified me?

nabz15 - forgive me if i show no nthuseasum to these breaches. no one is going to entertain in and they know it. i dont think you should rely on that as eventually you'll end up paying for it and they'll go scott free - i;ve seen this situation happen 100 of times, literally... sorry mate i'm just being honest.

Nabz15, to register a default QQ must have sent a default notice to you outlining the debt etc..

 

Ask for a copy of this letter, and do this all by email. If you get no response (which looks likely) send a copy of the email and a covering letter to the credit ref agency demanding they remove the default as the correct legal procedures have not been followed.

 

This will take time, but QQ are fully within their rights to refuse to remove it until the debt is cleared in full.
