Make sure you report them to TS and the OFT via consumer direct for using the Insolvency Service as a means to collect debt.

I hadnt thought of that so thanks very much for the advice. It does seem a very heavy handed approach to take over a costs order particularly when I had made it abundantly clear that I was going to pay. I will have a look at the consumer direct website later.

An SD can be served on a debt of £750 +...

 

The OFT have, however, given 1st crud a warning about abusing the Insolvency Service...

 

Consumer Direc will have all the info you require, just in case though, national debt line will have it too. Just mention OFT sanctions :)

Well as I have paid them £500.20 that leaves £744 outstanding to pay so if my maths is correct thats now less than £750.

 

I will definately give your suggestions some serious thought.

Very interesting information, I have to get a letter drafted to these pests, they are driving me mad at the moment!

 

The OC is yet to comply with my s78 request from a while ago and I do have written confirmation that they can't supply the T & C's that applied at the time (1980's)!

Guys that information is very intetresting - particularly the news article. This bunch have made several threats to use a SD in the past when they were gave it to Connaughts and there definately was a few threats to use a SD and also to make a charge over our property etc. This was for the alleged debt that they havent yet proven they have a legitimate claim to so I am definately going to mention this when I write to the OFT & TS. they sent a total of 17 demands for payment when they hadnt even complied fully (and still havent) with the original S78 request back in 2007!

 

Interestingly the payment I made hasnt yet been taken out of our account and it does say on the email confirmation that the email is only confirmation that the transaction was completed but it doesnt mean it has been accepted by 1st Cr. it will be interesting to see if they accept my proposal to pay the balance in 6 instalments.

 

I am almost finished doing the AQ and then I can turn my attention to registering yet another formal complaint.

I believe it's time for a campaign to encourage

all Caggers who have been affected by this type

of abuse to tell us on CAG and perhaps we can

duplicate the successes of the HFO fan club:madgrin:

Double and treble check that the payment goes through. If they refuse it just to try and follow through the SD, they will be opening up a whole can of worms for themselves... and vexatious would only be the start of it.

Brig it appears that there are some companies in this country that feel they can go around abusing regulations and the law. If us mere mortals behaved like this we would definate;ly feel the full force of the law coming down on us heavily.

 

I know some people have doubts about the effectiveness of making complaints to the OFT & TS but people must keep making complaints if anything is going to be done about the unethical, immoral way that some companies insist on conducting their business.

 

BTW Brig do you know if anyone had ever contacted any of the national press about this type of behaviour.

 

THe HFO situation is a great example of a company being brought to account. Do you have a link that tells the full story?

Checking on the hour Donkey! It may be their systems take a day or two to process payments so I will see what happens by the end of the week.

 

I have asked for confirmation from them so lets see what happens.

 

BTW what is tyhe process if they do refuse it - do I then apply for the set aside or is there another course of action? I definately do not want to be involved in bankruptcy proceedings particulalry when i have tried to be as reasonable as I can be.

Hi just look at any of the HFO threads there is a multitude.

I could certainly look into records on press involvement

which is relevant, without checking throughly I would

not like to state any thing as fact as I am aware of possible

incursions here from others.

Brig also take your point about being careful what is said on a public forum in respect to the press. You don't really think our friends in Surrey would try to use what is said on this forum against anyone in court do you? Oh wait a minute - they alredy tried it and failed misreably didnt they :) :)

law firm, advice bureaux, the nonsence of
