Hi guys.

Received a ltter for moorcroft today, deemanding what i consider to be a strange amount of money.

Letter does not say what it is for, however i have only one debt left thats in dispute, and the demand is for the final amount that was paid on a loan six months ago.

 

I am considering replying with this, any thoughts?

 

I would point out two items with regards to your demands for 3284 pounds that concern me.

Firstly, you have not stated what the alleged debt is for.

Secondly, I am fully aware of where all my debt is owed, and the exact amounts owed, I have no debt with this amount owing.

 

Thats after the normal formalities of course.

Dear Sir/Madam

 

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

 

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

 

I am/we are familiar with the CPUTR 2008 and the Office of Fair Trading's Guidance on debt collection, which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

 

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. AND in not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

 

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

 

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

 

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to Trading Standards and also inform the Office Of Fair Trading of your actions.

 

I/we look forward to your reply.

ahh thats the one, thanks ceberus, i forgot a lot of stuff cos i havent heard anything since jan on the one i have left.

Happy to say now that it is the only one, after finding the other 2 enforcable and making settlement arrangements :)

yeh usual tricks, they have an amount that ive paid mixed up with one allegedly owed, but so far unenforcable, i liked the app form they sent with no prescribed terms.

Bit coincindental that the interest adds up exactly to a debt thats been paid.

Also, i havent claimed back charges on that one either, so the interest will likely be unlawful to :)

Moorcr@p will no doubt collude with their client and send you something purporting to resemble evidence of an agreement..

Send them a breakdown of your costs in dealing with these matters, stationary, cost of labour, postage etc, that should help them....

that would be the problem for them haha,i only have 1 debt left, its for less than half the amount claimed in their letter, and has been in dispute for over 18 months.

Although theyll claim its interest, theyll have to show how they add it when the account is in dispute.

The agreement for the one i do have has no prescribed terms on it either, so im not worried at all.
