Hi,

I'm a claimant. I filed a claim against two defendants. One admitted the claim (unspecified amount) and the other didn't respond by the deadline, so judgment has been made for an amount to be decided by the court. The claim was for £>5k

 

I've now received an Allocation Questionnaire - I was expecting, from the HMCS Notes for Guidance, to receive either allocation to the small track (I know the amount claimed is >£5K) or to a disposal hearing - whereas the questions in the Questionnaire seem more appropriate to a hearing when there will be a defence.

 

I've checked with the court office and they insist that it all needs to be filled in. Is this because disposal hearings can occur in either small/fast track?

 

Is there any harm in asking for the small claims track? I am a litigant in person.

I am just letting you know that as you haven't had any replies to your post yet, it might be better if you post your message again in an appropriate sub-forum. You will get lots of help there.

 

Also take some time to read around the forum and get used to the layout. It is a big forum and takes a lot of getting used to.

 

 

Once you start to find your way, you will soon realise that it is fairly easy to get round and to get the help you need.

 

It can be bit confusing at first.
