Hi

A few months ago i decided i had to stop rolling over my tower capital payday loan,it was £150 + interest,i as upfront explained i was having problems,they emailed me telling me they would only accept 6 payments of £40 to clear it and no less,i agreed to this and paid the first payment only to find myself struggling again so i emailed them telling them i could pay no more than £20,they wouldnt accept this and after lots of discussions i recieved a letter from northampton county court for a debt to tower capital for £286!

I went online to the courts website and followed there instructions, i did admit to the debt but only admitted to the original £150 less the 40 i had paid.

This morning i recieved another form telling me i did not respond in time and therefore and a judgement has been entered and i have to pay £286 immeadiately, i rang the court who told me the form i filled in online was sent to the court instead of tower capital and therefore that was why tower entered judgment as they had not recieved it in time.I asked what can i do next? they said i can apply to havethe judgement set aside and they will send me the forms but it will cost me £35!

Please can anyone advise what this means and what i can do? ive got lots of debts but nnever in my life recieved a ccj and cannot believe i have one for a £150 loan :-(((((((((((

Thanks today i recieved another letter with details on paying £35 to have it set aside,it also contains a form to fill in,i desperately need to sort this but dont know what to do,i could probably be able to afford half the bill this month but cannot pay the full amount,i cannot believe tower capital have done this when i have tried to come to an arrangement with them,it wasnt even sent to debt collection?!Please can anyone help,how long have i got before someone comes knocking on the door?! im in such a state,please help.

Don't worry, just search setting aside CCJs on here and there is plenty of help.

 

If you can't set it aside and you pay the judgment off in full within one month of the date of the order then it will be wiped from your record like it never existed.

 

Get it done asap as now there is a forthwith judgment the Claimant could unfortunately apply to send the bailiffs round at any time.

Just relax. You need to search these forums to find out how to have the judgmet set aside, there are plenty of threads on it. Yes you should have read the claim form properly and sent the I&E to the Claimant but just explain that it was a mistake etc.

 

If you feel the CCJ can stay on your file then you can apply to have the CCJ varied to include installments that, if maintained, the Claimant cannot take matters further. You could also make an offer to the Claimant for repayments.

Thanks sorry for getting wound up just so worried,never had a ccj before.

If i spoke to tower capital then and offered repayments do you think they would help? ive tried before to no avail,hence the ccj,i originally borrowed £150 and paid off £40 on an original payment plan i couldnt at the time keep up with, i now owe £286 with court costs!!,wish i could have paid it off a few months ago but couldnt,i can afford the original loan amount but no more this month.Thanks for the advice :-))

Tower Capital will not help now, they will just screw you even more. Get the forms filled in for a set aside and get them to the court as soon as possible. You should get this on the grounds that

 

1. Their default notice is defective

2. Their claim is grossly inflated due to excessive interest and charges.

3. It was originally an unsecured short term loan and now prejudices other creditors with more claims on your limited funds....

 

Get that form filled in and sent off pronto....

I dont recall having a default notice,just forms from the court who have been very unhelpful with what to do next,im going out of my mind at the moment as this is all new to me,all i want to do is try to come to an arrangement before i get visits from baliffs:!:

Hi

I contacted tower yesterday and this was their reply:

 

 

Thank you for your email, the contents of which have been duly noted.

 

Your current County Court Judgment balance is £286.00, however in order to assist you in clearing this balance as soon as possible we can present the following options available to you;

 

1) A full and final settlement figure of £164.00 to be paid within 7 days in cleared funds. This would mean that you will benefit from a large discount in charges to the sum of £122.00. You can also apply to have the CCJ revoked once this payment has been received. This would mean that there will be no record of a CCJ in your name.

 

2) Two monthly instalments of £100.00 with the first instalment also being received within 7 days in cleared funds. Upon receipt of the second instalment you can apply to have the County Court Judgment satisfied.

 

3) Monthly instalments of £50.00 however please be advised that this will be until the full County Court Judgment balance is paid.

 

Please contact us by return email or by calling to the office on 01202 203180 within 7 days to discuss the options available to you.

I want to do it in 2 payments,wish i could do it in 1 but cannot afford it,just wondering if it seems reasonable of them and if anyone can advise if this is the best way as i just want to get rid of it.

how did you get on with this? did they remove the CCJ. I have a ccj from them and was wondering if i offered full payment immediately if they would consider removing my ccj????????

 

 

 

If you pay in full within one month of the CCJ then it can be removed completely as if it were never there.

Apologies for the late response,i cpouldnt pay my debt back within the month so i emailed tower capital offering them a payment and have paid this since,the ccj was entered against my credit file and to be fair i also dont recall having a default notice,i was a little naive with the court papers,i should have dealt with it sooner but as i didnt understand it kept putting it off.Ive now got ccj,s and court papers coming out of my ears! How are you getting on with it?

Hi, I asked for a copy of my default notice and they states that they issued it on the 14th by 2nd class the date on the default is the 14th giving 14 days to pay it stating payment to be made by the 28th is this valid as it isn't 14 days from when I supposedly recieved it but 14 days from when they apparently sent it

You won't get it set aside just because of the default notice, you should have got onto this forum much earlier and we could have had the CCJ overturned. Can you post up the original particulars of claim as that will give more ammunition to ask for a re-determination hearing.

 

Your other alternative is to get an N244 form and fill it in for a variation, and also argue against the original sum owed... haven't done one of these for some time so don't know if you can argue the original sum is wrong now.
