      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have to agree WG, it's getting a bit out of hand and not for the better. There is going to be so many posts in the wrong place as it is no longer obvious where one has to post or ask a question.

 

In fact, the forum is now one big mess.

If it isn't broken why try to fix it?

 

Everything was fine up until a few weeks ago. Now things are awful.

 

The forum needs to be put back to how it used to look, this yellow & blue theme is hard to look at.

ive been off the grid for the last few months and came back yesterday to find cag is so user UNFRIENDLY

 

please please revert back to the old cag

 

i can no longer find anything or spend ages trying to navigate the forum

Agreed - the new layout is most bizarre.

 

The Parking and Traffic forum is now located between the NHS and PPI forums.... and so on.

 

If the forums were to be split up, as they have been, care could have at least been taken to group similar categories together.

 

At present, the forums look unprofessional and will be confusing to newcomers.

I too am getting really frustrated with this continual p1$$ing about with the layout. All was well till last month when the major new software change was done (and not for the better, far from!)

 

Now, I can't find the few forums that I generally take an interest in which were nicely grouped under the "motoring" section. This is really bad now to the point I am fast loosing interest in CAG. :(

Might as well just ditch it all and have the one section 'Consumer issues', I can see most things on all subjects will be posted there. The silly little collapse a section arrows aren't explanatory and so small they are easily missed and not everyone is a Bill Gates anyway.

General colour and layout not to bad, there again I have not been a member that long the old version was better. :rip:

I have found frequently that the forum is just 'off line' recently. You know, you go to have a look and you get 'server not found' or similar.

 

Then after whinging like this yesterday, the site went off at about 4pm with the message 'site upgrading, back about 5pm'. which wasn't back after several looks up to 11pm.

 

So, I am saying right now that if the people who run this forum cannot get their act together and just leave the effing thing alone, I will leave. I don't get paid to be here. I am not one of the directors of what is after all a limited company. Pull your finger out, sort it out and then leave it alone.

 

The very next time I see 'server not found' or 'upgrading' will be the last time I bother visisting. You are taking a good and popular forum and spoiling it.

I have to agree again. Updates/upgrades should be done between 02:00 and 05:00 and not during the day.

 

To me though the worse part is the illogical layout. I mean, Computers and IT is in the middle of no mans land on the general info section, what's that all about. Plus, why no one ever bothers to explain, apologise or asks if everyone is happy, it's a case of lump it if you don't like it.

The silly little collapse a section arrows aren't explanatory
if you use them it goes away

 

I found it as I assumed it was something to do with advertising (I use the zoom page in opera a lot) which usually causes this. Seams a bit pointless unless I can edit the links in there for fast switching. Can I? Who knows and more importantly who cares?

I have to admit to not liking some of the changes but this site is now (in construction at least) similar to when I joined the site and all the composite fora were separate.

 

I would like to see groups of fora replaced as the motoring related ones used to be. Having said that, I am ok about some of the changes - though am not sure about the 'Consumer Forum Menu' at the right hand side of the page as it is bunching up the thread and making each post take up more space on the page.

 

Just my tuppenybit.....

I used to frequent the site until they upgraded(or downgraded) and now I just can't find my way around.

 

without being modest i know a thing or two about forums and there was no need for such a transition, it would have been better to modify the script

Well done speedfreek! I had no idea about how to stop it being in a narrow box down the middle of my screen. Fixed now, but still think the changes are cr%p.

No one "high up" has commented on this thread. Even if it was to tell us to like it or lump it, some contact would be nice.

The only advantage I have found in the past day or 2 is that normally when I have been at work all day, I have a mountain of threads to read to catch up with the forums. Now hardly anyone is posting so it takes no time at all to read through the outstanding posts. :-D
