I have received on 26th August a Charge for Payment of Money from Alex M Adamson (Scotland) for Council Tax Arrears I have made payments monthly until last two months got in to difficulty. They now wish for me to pay the arrears which ofcourse I cannot. I have offered to make a small payment today and a further in two weeks time plus new direct debit they did agree to this but I cant make the small payment till next week. On the charge for payment of money letter they date it states I have 14 days to pay the arrears or further action will be taken :- Arrestment of your earnings, money attachment and the attachment and aution of artilcles belonging to you.

As I have offered to do the above payments do you think if i pay the small payment within the 14 days they will stop any further action???

They know my employer details but to be honest i would prefer if they did arrest my wages as this has worked with me before in payment then as they cant take as much of, which is alot less than what Ive been payment myself each month.

They know my bank account details but i never have alot of funds in it will they still freeze account even if there is no funds???

Any advice would be most appreciated.

Thanks in advance

hiya,

if the try your bank account they can only take monies if the balance is over £370

if you do nothing for the charge for payment they will likely go for a wages arrestment

I note from your post you would prefer this as yes it is sometimes a smaller amoount and more manageable

you can also apply for a time to pay order via the court if you wish:

The cannot remove any monies from it but the bank may freeze the account untilt he SO's clarify it is ok for you to use it.

You generally find they will only go for the bank acc or wages arrestment, not both together so is always best to kepp a minmum amount in the account if you have to.
