Hi all,

 

I am in a situation where my Landlord will not release the keys to my flat because one tenant out of 6 has not paid the first months rent.

 

Everyone else has paid in full in addition to a £200 deposit. It means I am having to stay in a hotel until the last tenant pays the rent, what are my rights in this situation?

 

Surely I could move in as long as the person who hasn't paid stays out?

Thats a really tricky situation.

 

Technically it is irrelevant whether it is one or six who havent paid - the law classes you as one tenant.

 

However, the question is, arrears or not, does the landlord have the right to prevent access? He probably does, as the tenancy has not commenced until you actually move in.

 

This one isnt straightforward at all....

 

Why hasnt the tenant paid the rent, and when are they going to?

Assuming they are all named on one AST (rather than having one each) its even messier as you can only have 4 names on 1 AST!
