    • Hi, first post here   My daughter has a progressive illness and is, just recently, 20 years old. She is enrolled as a full time student and until last weekend I received tax credits for her. I am her appointed person, She receives PIP at highest rate for personal care and lower rate for mobility. I receive carers allowance and also am self employed, around her needs. She does a very odd shift working, possibly one or two 4-5 hour shift a month.   In the past I understand that she would have been entitled to ESA whilst a student as she receives PIP (the bursary form we have completed for low income towards travel and materials for her course, NOT any 'living costs' asks if she is in receipt of universal credit or ESA)    I went online and made an application through the only online form available (new style contributions based) they told me as it was filled in her name I would need to ring a number for Contributionary ESA but she would only get a credit, as not paid enough. She didnt seem to know anything about income related.   She said she might be able to apply for universal credit.   I heard that there is some sort of magic way of applying - something to do with you not being able to get ESA without a work capability assessment, and because she is a student they wont do one because she isnt entitled to UC. However someone else told me that because she gets PIP she is automatically exempt from the WCA. And that as a disabled student she is entitled to income related ESA. And yet another person told me that you need to apply for universal credit and ask them to defer the payment until the WCA is done (which she shouldnt need as she gets PIP)...   Its all very confusing, and in the meantime the tax credits have been cut by a huge amount and council tax have placed me on a minimum income floor and charging me a whopping rate of council tax

    • Okay, it looks as if you are making progress although it's obviously very tricky. However, one important point – if something does happen then I'm afraid it's not their liability, it's your liability in terms of any criminal responsibility – and in terms of your insurance because you know the condition of the car and you are deciding to drive in that condition. So I'm not trying to give you too much of a fright – but you should understand the situation. So I expect that you are going to drive the car – I expect it's going to be okay – that you should drive the car very carefully and slowly.

    • I came across this discussion recently and just wanted to give my experience of A Shade Greener that may help others regarding their boiler finance agreement.
      We had a 10yr  finance contract for a boiler fitted July 2015.
      After a summer of discontent with ASG I discovered that if you have paid HALF the agreement or more you can legally return the boiler to them at no cost to yourself. I've just returned mine the feeling is liberating.
      It all started mid summer during lockdown when they refused to service our boiler because we didn't have a loft ladder or flooring installed despite the fact AS installed the boiler. and had previosuly serviced it without issue for 4yrs. After consulting with an independent installer I was informed that if this was the case then ASG had breached building regulations,  this was duly reported to Gas Safe to investigate and even then ASG refused to accept blame and repeatedly said it was my problem. Anyway Gas Safe found them in breach of building regs and a compromise was reached.
      A month later and ASG attended to service our boiler but in the process left the boiler unusuable as it kept losing pressure not to mention they had damaged the filling loop in the process which they said was my responsibilty not theres and would charge me to repair, so generous of them! Soon after reporting the fault I got a letter stating it was time we arranged a powerflush on our heating system which they make you do after 5 years even though there's nothing in the contract that states this. Coincidence?
      After a few heated exchanges with ASG (pardon the pun) I decided to pull the plug and cancel our agreement.
      The boiler was removed and replaced by a reputable installer,  and the old boiler was returned to ASG thus ending our contract with them. What's mad is I saved in excess of £1000 in the long run and got a new boiler with a brand new 12yr warranty. 
      You only have to look at TrustPilot to get an idea of what this company is like.

    • Dazza a few months ago I discovered a good friend of mine who had ten debts with cards and catalogues which he was slavishly paying off at detriment to his own family quality of life, and I mean hardship, not just absence of second holidays or flat screen TV's.
      I wrote to all his creditors asking for supporting documents and not one could provide any material that would allow them to enforce the debt.
      As a result he stopped paying and they have been unable to do anything, one even admitted it was unenforceable.
      If circumstances have got to the point where you are finding it unmanageable you must ask yourself why you feel the need to pay.  I guarantee you that these companies have built bad debt into their business model and no one over there is losing any sleep over your debt to them!  They will see you as a victim and cash cow and they will be reluctant to discuss final offers, only ways to keep you paying with threats of court action or seizing your assets if you have any.
      They are not your friends and you owe them no loyalty or moral duty, that must remain only for yourself and your family.
      If it was me I would send them all a CCA request.   I would bet that not one will provide the correct response and you can quite legally stop paying them until such time as they do provide a response.   Even when they do you should check back here as they mostly send dodgy photo copies or generic rubbish that has no connection with your supposed debt.
      The money you are paying them should, as far as you are able, be put to a savings account for yourself and as a means of paying of one of these fleecers should they ever manage to get to to the point of a successful court judgement.  After six years they will not be able to start court action and that money will then become yours.
      They will of course pursue you for the funds and pass your file around various departments of their business and out to third parties.
      Your response is that you should treat it as a hobby.  I have numerous files of correspondence each faithfully organised showing the various letters from different DCA;s , solicitors etc with a mix of threats, inducements and offers.   It is like my stamp collection and I show it to anyone who is interested!

About 3 months ago I instructed Claims Financial to act for 3 PPIs. I got a letter from Nat West that they would not pay the compensation. The second company was Southwark Credit Union, about two weeks ago I got an invoice from Claims Financial that the information I gave them was not correct therefore they attached an invoice of £129 to be paid by me. Since then they have been calling me on the phone, texting and emailing chasing me for money. I wrote to them to explain where they got it wrong, I wrote Southwark Credit Union on the PPIlink3.gif form sent to me but they have been writing HSBClink3.gif instead. The forms I sent to them was meant to be sent to Southwark Credit Union and not HSBC. Now it my fault that the the form was sent to the wrong company and again they want to be paid for the mistake. Up till today they continue to text and phone me to pay their invoice. Is it possible for me now to send another letter to Nat West directly for the PPI and the third company. Can you please help me with the letters. The third company Swinton Insurance sent me a cheque for £17.

First things first, get rid of these leeches Claims Financial. They will just keep hounding you and pestering you in the hope that you will give in and pay the money. They have absolutely no legal standing to pursue you for any money. ]


So be firm and confident, show them you will not be bullied and manipulated into paying them.


Something along these lines should work:


To Whom It May Concern,


I refer to your repeated calls and letters demanding money from me when I have done nothing wrong.


It is you and not me who has made the mistake in sending the forms to the wrong company. Therefore I have no intention of paying your invoice or any other money to you.


I consider your continued calls and letters to be harassment and hereby notify you of such. If you continue to harass me I shall take further action against you, including reporting you to FSA, Office of Fair Trading and any other regulatory body I see fit to contact.


Do not contact me again by telephone or any other means apart from in writing.


Yours faithfully




Send recorded delivery to their head office blueeve.


In terms of contacting the companies yourself, this is entirely up to you.

Hi..........You are now aware of bad move,using CF...........write them and state they have not carried out your instructions to your satisfaction and their services are no longer required,and if they persist in harassing you the matter will be passed to OFT...............You are trying to recover PPI payments that you feel where mis-sold,before advising you how to proceed,what basis do you feel PPI was mis-sold,for example are you self employed????where you forced to take out PPI as part of the original agreement?????????have you an underlying medical condition?????????these are some of the reasons that mis-sold PPI can be challenged.......................The Swinton Cheque seems a very small amount,what did they write you to arrive at £17,if you have not cashed it ,hang fire dont...........FS

Thanks for your replies. I still have the cheque, but because I have instructed the Claims Financial to write to them. I need to write to Claims Financial to stop representing and will send another letter directly to them to pursue the PPI claims. Thanks I really appreciate your help
