Hi,

First time I've looked in here in a long time, so long I'd forgotten my password and set up a new user.

 

Several years ago I managed to get Capital One to cough up the charges they'd had from me, and charged them 31.9% interest on them under reciproicity as that was their cash advance interest rate.

 

I have looked at my Barclaycard statements now and can see that I could claim the fees back.

 

My question really is has the procedure for claiming fees back from credit cards changed at all in the last 4 years and are there any up to date claim templates, or should I just use the ones I have from last time.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

the usual process!

 

you just keep at them

 

have a look at some threads in the cap1 forum

 

they go on about only paying the diff [to £12]

but they cough in the end

Went through all the request for data, asked them nicely for the charges back, they refused, prepared a schedule of charges + 8% interest, they refused, wrote a Letter Before Action, outlining charges plus 8%, they again declined, issued an N1 County Court Claim, detailed 31.9% interest and why. They ticked the box for wanting to time to mount a defence, got to the deadline and I received a letter offering me the charges (about 500) and roughly 2500 in interest back, without any admission of liability etc.

 

Was definitely worthwhile :)

Could you let me have the POC's

 

I have given them til next Wednesday to refund all plus 22% and so will need to file then. There is a template that I found, but it doesn't really mention the restitution bit, which is what makes all the difference.

It's the N1 that I need help with now, I have done all the letters and charges etc Their time ran out today, but I won't be able to issue the N1 until next Wednesday.

Hi Jazzer,

 

Sorry, I need to update some of the links in my signature.

 

You can still reclaim all penalty charges form BC and claim compound interest at their contractual rate (eg the cash advance rate as shown on your monthly statements).
