    • When I go into MCOL the only document is the Defendant's Response from Sept 4th, there they state that they dispute the claim and then every space on the form states "see the email we send to the courts and N244 etc". (uploaded PDFs above).   So does the latest N244 and witness statement count as their defence? Feels like a complete abuse of process.

Summary judgment applications are suitable in cases where the party making the application considers that the case is a clear cut matter of fact or law, in which oral evidence is not required. It is also used when the applicant considers that the other party has insufficient evidence to prove its case. There are considerable potential savings in terms of time and costs.   An application notice must be completed, then filed and served along with the supporting evidence - usually a witness statement together with copies of any supporting documents. The supporting evidence will set out the reasons why the applicant considers summary judgment to be appropriate.   The respondent also has an opportunity to rely on written evidence, which must be served in good time for the hearing.

The regulations announced by Boris Johnson last Thursday state that “workplace canteens may remain open where there is no practical alternative for staff at that workplace to obtain food”.

      I bought some clothes online in may through Evans and paid through PayPal
      returned them all seven days later
       
      I waited the 14days for my refund and no refund came
      I put in a dispute through PayPal but I didn’t get any emails to escalate the case - PayPal closed it. 
      evans said they couldn’t refund the money because PayPal have cancelled the refund because of the open dispute
       
      I contacted PayPal
      they said the dispute had been closed but Evans at no point had attempted a refund.
      fast forward to today
       
      I’ve got copies of numerous messages sent to and from twitter messages as it’s the only way I can contact them
      I’ve also contacted their customer service too
      all I get is PayPal have cancelled refund because dispute is still open.
       
      I have proved that the dispute is closed
      I have got an email saying that if Evans sent the refund they would accept it
      but up until the date I got the email they have not once attempted a refund .
       
       I have sent them a letter before court email
      I have even offered to have the full refund as a gift card just to get this sorted !
       
      I’m literally at the end of my tether and don’t know where to turn next !
       
      i suffer with mental health issues and this is affecting my health and I’d saved the money for a year to buy these clothes as I’m on a low income .

Hello all, I'm wondering if this is the right place to ask this question or indeed if anyone could point me in the right direction to see if I can do anything about this. I have asked the question on the MSE website but was generally made to feel even more stupid than I know I am! If is not the right place then please accept my apologies. But here is mt enquiry anyway.

 

I have just had a pension forecast from my employer ( the NHS) and have been informed that i do

not have Mental Health Officer status and that my pension contributions did not start until 1995. Now I started to pay into the NHS pension scheme in 1988. I was young and daft and I was advised by a pension salesman to transfer my pension out of the NHS scheme into a private one - InterLife so I did.

 

I rejoined the NHS scheme in 1995 but have competely forgotton that i had transfered my contributions to InterLife.

I accept that I have not got MHO status and my pension will only start from 1995,but I do feel that I was missold this pension and I would like to know where my contributions from that time have gone.

 

Is there anything I can do about this?

 

I was very stupid I know!

I have just done a similar check for my Oh and have found 2 for him htat he forgot about.

 

they can check all pensions and even trace the one you are looking for

Hello,

I have completed a form sent to me by the Financial Services Compensation Scheme. They sent me a letter yesterday telling me that they have sent my file to Hazell Carr - a firm of independant consultants- they will be carrying out work to investigate whether I have suffered a financial loss as a result of the advice i was given.

 

My question is does this mean that they are taking my case seriously, I wait everyday for a letter that tells me that I have no case and to go away!!

Hi all quick update,

 

The FSCA have located the pension provider - it's now Reliance Mutual. I have received a reply from there compliance officer. She states that I was written to in 1998 by the original policy holder and as I did not reply I am now time - barred from making a complaint. I had moved house 5 years before they wrote me the letters and did not receive any correspondancce at all from anyone.

 

I have made a complaint to the FSO but I will admit that thinks do look bleak for me!

 

Does anyone think that I have any case at all?

You can try using the Limitation Act Section 32c to try and get around their arguement.

Basically saying that the limitation period starts from when you was first made aware that there was something wrong and that you had cause of action.

It is only recently that you have become aware of these facts.

 

Its interesting that they still appear to have docs for you from 1998.

This is the reason everyone should keep an updated list of who to inform and what about so they can keep companies and important people in the picture of circumstances such as address changes.

 

God forbid that something might happen to you, it will make the life of those who have to sort things out easier and without the chance of missing something, maybe something you have paid all your life for.

I am just letting you know that as you haven't had any replies to your post yet, it might be better if you post your message again in an appropriate sub-forum. You will get lots of help there.

 

Also take some time to read around the forum and get used to the layout. It is a big forum and takes a lot of getting used to.

 

 

Once you start to find your way, you will soon realise that it is fairly easy to get round and to get the help you need.
