I have received a letter from Robinson way with a "Formal Demand for Payment"

and "our client has authorised us to recover the full amount you owe, shown above. This is a formal notice of intemded court action. We may take action unless you pay the full amount you owe within 10days of the date of this letter"

The letter was dated 23 August and received on the 23 August with S type stamp!

Firstly I sent a cca request many months ago to Marbles, they sent me an illegible copy of the agreement. I have repeately told them this but all they did was sent a reconstituted one and say that was good enough.

They did however many months ago state:

“While we try to locate the full original agreement we will not be seeking to enforce the agreement”

They have never sent me a copy.

so what should I do about this RW letter? Have they got any rights to pursue it in court?

doubt it

just chancing their arm by the sound of it.

see if you are a mug awaiting to be fleeced.

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Yes I thought so dx, and does the fact that they dated the letter in the future (they couldn't have possibly written it on the same day it was received!!) make it invalid anyway?

the letter is meaningless anyhow

just a std threat-o-gram.
