Esa tribunal and supporting evidence

I got my letter from ESA to say my appeal is going to tribunal and also the letter from the tribunal asking if i still want to go ahead.

What supporting evidence is needed?

 

I had my medical back in april and got 0 points.I have a brain condition called intercranial hypertension (too much fluid around my brain) and pappilodema(swelling of the optic discs) these are both connected.

 

I got 0 points as they say there was nothing wrong with my vision,in july i had an operation on my optic nerve sheath to prevent any further eye loss as i have lost some of my visual fields.

I mentioned i have dizzy spells and have blacked out,still got 0 points.

On the form it says i go to the park every week lol don't know where they got that idea from

They seem to think i am claiming for blood pressure when it is brain pressure.

 

So what evidence would help me,i have all my appointment letters from the hospital plus some which the consultants i see sent to my doctor.I will print details of my illness out from asbah to explain the illness.Is there anything else you would take?

Proof of prescriptions and a letter from your GP would help. You should describe in detail how your condition effects your daily life, both mentally and physically (make it your worst day).

 

The Welfare Rights officer from the Social Work Dept will help you and be there on the day of the appeal.

Thank you for replying.I will ring the welfare rights in our town tomorrow they only open 10-12pm.

 

Some of the things in the form are laughable.Was mentioned my vision was 6/9 which is not bad.My opthalmic surgeon says it is 6/15.which is quite bad.

Hi there. If you can get letters from your specialists as well, that might carry more weight with the tribunal. I would say get hold of everything you can.

 

Welfare Rights are great and I hope you get their help. I have a humble sticky on this forum that I wrote hoping to help people with their appeals.

Hi, Did you tell them you had a pet because I heard somewhere that they decide that you must be walking your dog if you have one and thats how they could have decided you go to the park.

Its the same as when they ask you if you watch films on T.V, then they decide you can sit for over an hour.

If you say you go shopping, we all have to go shopping, then they decide you can walk for 20 minutes, they dont seem to take into consideration how much pain we maybe in or how difficult it is in our day to day lives.

I don't go shopping or cook. I phone out for takeaways and pay for it with my plastic.

My area doesn't have a Welfare Rights person and the CAB do not represent people here. I was lucky to find an Advocacy Service for(mental health problems) and they have someone to represent me.

It gets me so angry when the dwp denied a person's illnesse perhaps you should get the definition fact of your illnesse and shove it up their noses and also try and get detailed explainations about dizziness and blackouts on how a person function can be disabled when one has an episode. You'll will find not always all the evidences you have may help. Find out if there are others with similar illness as yourself and if they are receiving any benefit due to their illness once you find someone else with the same symptoms and they get the help they need from the dwp then why can't you receive help also these are the questions you need to ask them what are the descrimition against you as a person that's what I intend to do with my medical this time round they totally denied my illness and I failed both the esa medical and dla I am not worry about dla but I shall fight for the extra money for Premium as I need to get myself back on my feet and to work. There are many with my conditons that gets dla and esa so I will asked the medical people what's the difference between them and me and why are they denying my illness and on what ground when you see Mr. Glegg and Cameron always say those who are in need will get help aren't you one of those that need help. There are the Ombudsman if all fail.

 

I believe all the questions the medical people ask is a lot of crap about sitting, standing, picking up whilst it does apply to some but not always to others but that doesn't means you don't have an illness also there is a vast difference about sitting down for 2 hours than 8 hours which you will clock in when working I've worked for 27 years so for me I know full well the vast difference.

 

I wrote all this just to give you an idea hope this help because no longer writing having severe pains, need encouragement and help for this and that seems to work with the dwp so you need to go down the root of law fact base.
