Hi, I bought a second hand car last week from a small dealer and the car is making a rattle noise over bumps. I rang the dealer and he said I would have to pay for it. Also I was only given one key which is the spare when he originally said there was two.

 

What are my rights in regards to any repairs and am I within my rights to demand a main key?

 

Hope someone can clear this up a bit.

If he has already refused you a repair then you must write to him by recorded delivery and demand that he puts the car right in accordance with the Sale of Goods Act 'and' supplies you with the key as advertised/told he would.

 

If he again refuses, then you write again telling him that you will take it to the dealer to be fixed and forward a copy of the bill to him for reimbursement. You should also add that failure to pay the bill will result in a small claims against him.

 

Do it in writing so you have hard evidence. Don't phone unless you can record the call.

Excellent advise as usual from conniff. I will second what he said. A car sold by a dealer MUST be roadworthy and any faults within the first 6 months are deemed to have existed at the time of sale. Like it or not, he is legally bound to deal with this or face prosecution. I would send a copy of your letter, together with details of the situation to trading standards as well.

I am just letting you know that as you haven't had any replies to your post yet, it might be better if you post your message again in an appropriate sub-forum. You will get lots of help there.

 

Also take some time to read around the forum and get used to the layout. It is a big forum and takes a lot of getting used to.

 

 

Once you start to find your way, you will soon realise that it is fairly easy to get round and to get the help you need.

 

It can be bit confusing at first.
