Landlords must protect their tenants' deposits using a TDP scheme if they have let the property on an assured shorthold tenancy (AST) which started after 6 April 2007.

Does the scheme apply if I paid my deposit in 2004? Since then renewed the contract every year. Am I right to think that the my current tenancy started in Jan 2010, this is when I signed the latest one? Therefore my deposit should be protected, is this correct? I have never received a receipt or any other info regarding my deposit. Just curious, thanks.

If your current tenancy agreement was signed in January 2010 then your deposit should be protected - here is the DPS's view of the subject http://www.depositprotection.com/webcontent.ashx?docid=69ee5ef0-5ef6-4bd2-855e-d294b147f593

To check if your deposit is protected, use this form: http://www.tenancyanswers.ucoz.com/index/deposit_query_form/0-11

To my knowledge, this applies only to tenancies that have commenced after April 2007. Your tenancy (despite renewals) commenced prior to this.

However, also to my knowledge, this also hasnt yet been thoroughly tested in the courts.

In summary, this means that any tenancy which does not go periodic MUST then be protected under the new Tenancy Deposit Protection Legislation.

Seems it is supposed to Sheddy, unless the tenancy goes periodic which it hasnt
