Initial term of the tenancy vs Expiry Date

Hi all

 

I just wanted to know if I can leave a house in one month time, where I have been living for 11 months and the "Initial Term of the tenancy" is 12 months.

 

However, the notification period is 2 months and the "Expiry date" is "on rolling basis".

 

Does it mean that I cannot end the contract after 12 months?

In case I should wait two months, what is the utility of the "Initial Term of the tenancy" clause?

If you have a tenancy agreement for 12 months then you cant leave before then (well you can but you'll have to pay the last months rent) although you can leave on the day before the anniversary without giving any notice at all, as your assured tenancy has then come to an end.

Although most people do give notice that they will be leaving

I'm not sure what initial term of tenancy is unless its the same as an assured shorthold tenancy

I signed a contract for 12 months. I have been living 11 months in the property.

 

But in the "Expiry date" clause, it reads "on rolling basis".

 

Does it mean I still need to notify I want to leave two months before leaving? Can I just leave the house at the end of those 12 months?

As far as i'm aware you can leave the day before the 12 month anniversary date, if you stay past that then you will have to give 1 months notice to the landlord.

It doesnt become a statutory periodic tenancy (rolling tenancy) until after the anniversary date,

The end of those 12 months will be on half september.

 

The 'pull-out' clause says I can terminate the contract by giving the landlord not less than 2 months notice.

 

Does it mean I cannot leave the flat on half september?

If your tenancy date is 14th september then you can leave on the 13th without giving notice

After the 14th it goes onto the rolling contract whereby you will need to give your 1 months notice not 2

 

You need to be more specific regarding the tenancy start date

I signed for 12 months.

yes as far as the law goes as long as you signed an assured tenancy
