Need advice on paper work for car, six years off the street (no SORN, no nothing)

Hi all,

I'm trying to sort out a problem my girlfriend made for herself by purchasing a 2nd hand car six years ago. The problem is that she didn't actually get her drivers licence and just left the car in her parents' driveway. out of sight, out of mind situation...please don't ask.

 

As far as I know, its not registered in her name (we got some paper work that came with the car and that is in the name of the previous owner). She never attempted to take it on the road, and certainly didn't apply for a SORN.

MOT is gone by now, too.

 

She'd like to sell it now, but we don't know how to put the paper work in order first so we can do that. Any advice on how to go about putting all the papers right?

It would be pointless getting paperwork in her own name, as this would simply increment the number of RKs to no useful effect. Continuous Registration probably had not kicked in for her vehicle (whoever the RK was), so if she wants to sell it, many will want it for parts, so selling it for spares or repair only is a good way forward. Scrapping in may get het around £150 or so includng collection.

Just to clarify, RKs = previous owners? and also, when my girlfriend bought the car, should she have registered it in her name, or was it fine not to do it, since it was off the road?

Technically yes, but the RK is not neccesarily the owner - it may be, but equally it may not be. She should have received the V5C to fill in and send off for it to be registered in her name. This probably pre-dated the change that meant she would have to sign the V5C only, and the previous RK send it to discharge their liability as a keeper and to passit on as part of the continuous registration process. The risk (if any) then, was to the previous keeper, would could have been held liable for misuse. If she did not register herself as RK, she'd avoid this (another reason why Continuous Registration was implemented).

That's really interesting, so theroretically the previous owner might have sent in my girlfriends details and she might very well be the RK. Saying that we never received any communication.

 

What would be the deal if we sold the car on (parts/repair), would we need to get the buyer to sign the V5C and send it off? We would not want any previous owners to get into trouble for the old banger.

For Spares or Repair you;re really saying it is being scrapped, but if your GF is not the RK, there's little point in paying the £30 for a V5C to start the process again. You COULD enquire of the DVLA who the RK is, pay the fee and find out that way.
