    • Hi,     I'm in the process of voluntary termination of my moneybarn agreement, in accordance with secion 99(1) of the Consumer Credit Act 1974. I have returned the vehicle, it was collected by a 3rd party on behalf of MB, in driveable condition with fear wear and tear condition.  Their report states that the condition was "Average" (The options were Good, Average and Poor). I have paid more than 50% and recently, before starting the VT process spent £700 to make sure car is roadworthy (gearbox repairs). I am £880 over the 50% mark. Today I've received final billing letter estimating body repairs at over £1,300 (the bodywork is fine - peeling lacquer and alloy wheels would need refurb though). I've purchased the car at 7 years old with over 80k miles, through National Car Credit (pretty sure I've seen another topic on here about them). The car is now more than 10 years old, and I did take pictures + videos of the car before it was collected.   Now. I've had a payment holiday through April and May (which I don't dispute and will willingly cover the amount that they're asking for this payment holiday term) But however I'm not okay with covering the bodywork repairs for a car that is over 10 years old and wasn't excellent condition the day I've purchased it. It came with no service history book and only one key (on my own expense I've purchased another one and had it programmed)   No arrears on the account, no missed payments (just 2 month agreed payment holiday - between myself and MB) which I'm okay to cover. Given the car back in drive-able condition (it was very noisy the week before it was collected, hence why I've spent money on repairs) half of tank of petrol, kept tax up to the day it was collected.   Advice would be appreciated, thank you.   dx: I can't pm you as I haven't got enough posts on here, but if you'd like more details and see what has been sent and see the responses please PM me.     Thanks.
    • I am not a lawyer but I definitely think you are correct.   You will need evidence that Fast Track was not available on your way out - "Unknown reasons" sounds ominous. Do you have pictures/videos/written records to prove it?   Ryanair website states they are not responsible for you missing your flight as a result of fast track, but it doesn't say anything about not being responsible for the product they sold you not being available. Have you tried asking for a refund already?   Either way they sold you something that they did not provide - I don't see how this can be legal - and hopefully you should be able to prove it. Get written evidence that they refused to refund you (if you don't have it already) and take it straight to your card provider. (by many accounts it seems pointless to try and negotiate with Ryanair)

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Hi everyone,

I wrote to Santander on behalf of my mother who took out a Debenhams storecard in 1994. The card was takin out in store with the Account Protection box ticked and signed by someone called Audrey (not my mother). She paid this up until 2004/2005 when I cancelled this for her but didn't know at the time about refunding her.

Basically I have reached dead-lock with Santander who have advised me to go to the FLA (I have been told that the FLA are a waste of time).

What do I do next?

It's been 11 months since I last had any communication with Sanatander due to illness but I do have copies of the correspondance that was sent.

Any advice would be appreciated, and I am nervous about a court claim due to the amounts invovled (she paid about £80.00 per month for this policy for roughly 10 years). At the time that the storecard was taken out in Dec 1994 she was only working part-time, for the police who have there own sickness payment scheme, and was diagnosed with diabetes in 2002. She has never claimed from this policy, obvioulsy as she never knew she had it. Nothing about account cover was explained to her at the time she was offered the storecard, and she did not realise that it was optional until she got into financial difficulty some 10 years later. The account was arrears and is now been dealt with by CL.

Please help.

May be worth checking that out Yelah4u. Your mum should have received a letter of notification of transfer of this account to CL.

 

If indeed CL do own the account, it is they who are now responsible for any claim for PPI. Which may mean you having to start the whole process all over again.

Thanks, I will send them a letter. Would you suggest that also I stop paying them by saying something along the lines of the account is now in dispute?

do you have the agreement?

 

scan your sheets/agreements

remove all pers info inc barcodes etc but leave all figures and dates.

goto one one of the many free online pdf converter websites

convert the image to pdf format.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

browse to your pdf file and upload it

hit close this windows at the bottom below upload it box

Yes I do have a copy of the origional agreement from 1994 this was sent when I asked Santander for the SAR, so I will upload it but I am away from home now at work until early tuesday morning. So I will do it as soon as I get back home. Shall I just post it on here?

dx100uk, so do you think that I should go straight to the fos, as I have a copy of the agreement that Santander sent me after I sent my initial letter and the SAR that clearly shows that the account protection box was ticked and signed by someone called Audrey (not my mothers name)?

TBH i must be fair and say that your claim for PPI is always with the OC [ thats what i've always been told here]

however, as you've gone past the 6mts required to go to the FOS since the Oc's final response [i assume you have a letter stating that whatever the OC is saying HAS been their final response?]

if not i'd write them again with a spreadsheet detailing your claim and get a final response - then go to the FOS,

 

you will have to wait sadly, there is a huge backlog.

Yes, I do have the letter saying that it is their final response and that if I was unhappy to go to the FLA. So do you think the fos will take on my complaint so long after the final response from Santander?

I don't mean to be daft but was does OC stand for?

 

Or would it be worth pursuing CL, sending them a letter and stating the reasons why the policy was mis-sold?

Just to keep you updated, I spoke to the FOS today and they said that they would have a look at my claim, going back to 1994. They also said not to bother writing to CL.

So they have sent me some forms in the post and I will keep you all updated.
