Not that they've done anything about Menzies yet but he sounds like a blackmail risk.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The best I can come up with is:

 

Click top right Advanced Search

Then top right click Search by Type

Then Find Threads with 'At Most' and '1 replies'

 

For some reason if you put '0 replies' it returns a mixture of threads with loads of replies and ones with no replies.

 

There has to be an easier way, but I haven't found it yet

A lot of issues with the current situation maybe resolved just by bringing vB4.0.0 up to vB4.0.6

 

4.0.4 fixes 450 bugs since the release of 4.0.3.

4.0.6 fixes over 100 bugs since the release of 4.0.5.

 

So rather than spending so much time trying to resolve some issues, upgrading to the latest version available may help and save time?

 

I appreciate it is a lot of work to upgrade, but Webby would be peeing in the wind trying to fix everything and then risk the chance of having to do it all over again once you upgrade anyway.

I think that the move to v.4.06 is a very sensible idea. We'll discuss this with the WebMaster.

 

Some of the problems are definitely problems with our upgrade - and are fixable. Others are merely new features of the new version of the vB software and will take a little more work, I expect.

 

I have to say that vB seemto have changed some things just to produce a visible difference, even though thechange is not better.

 

The clutter which MB referred to in thread 1 is an example. The screenshot which MB has reproduced above is another example.

 

We'll try to address these but we'll have to try and get our installation fully working first and then we can try improving on what vB have written for us.

 

Certainly, the vB search function - which was never very good, is now really much more limited than ever. I can't imagine why reducing functionality - and effectively reducing choice - could ever be seen as good thing.

I think that it comes with the American village mentality. I like Americans a lot, but I used always to be amazed at how un-International and how un-savvy, Americans are. But it really is true. There is a sort of we-know-what-is-best-for-you attitude which can really put a damper on things. You have to remember that they were helped to their Independence by the Fwench and I think that explains a lot

From what I have read vB when they were bought out by Internet Brands got rid of / sacked / resigned a lot of the original coders. vB is no longer a personal company in my eyes. The difference before was the guys who were at vB pre the sale of, knew the product back to front as it was their baby. What you are seeing now is a commercial entity's product rather than a brand that was reknown for quality, being personal and it's willingness to work with the community, and not just for profit.

 

This is my opinion and not fact if IB are reading this.

 

vB3 is end of life and a lot of people who had bought vB were very unhappy with the way things went once the newer version came out.

 

Overall I do like vB4 but like you say, it should be right out of the box, not all the malarky that Webby has had to endure.

Yes, I've read the same things about vB and IB. Unfortunately I don't exepect that IB will read this or worry about it.

 

I have a sense that vB 4 = Vista and that there will be pressure to sort it out and that a Win 7=vB5 will be released in a couple of years.

A size limit would be very nice for when pics etc are inserted so that the page does not get thrown out by a large insert.

 

Smilies - could they possibly be changed back to the old style as the new ones are very similar to each other?

 

On thread replies it would be handy to see who made the last post like we used to be able to.

We are all very trusting when it comes to the Internet.

 

That flaw never affected CAG and was not even present in their older version of software that CAG used which was vB 3.7.0 or this one vB 4.0.0 - However I do agree, the upgrade was definitely needed for other security reasons.

The green dot which flags threads I am subscribed to appears in the main forum lists:

No big deal, is this just me or is this happening to others?

 

The green dot thingy should only appear if you have actually posted in that particular thread as far as I know.

 

On a none important issue, the actual green dot is wrong anyway. In the thread list it is like it is in your image, yet the icon legend it is like this. thread_dot-16-right.png (the wrong way round as in the arrow points the opposite way)

I find it especially difficult to read threads where an oversized image means you have to scroll sideways on every post. As indeed is happening on this page :-(

Either needs an automatic maximum set at around 540 pixels or a prominent note on the image upload box. That said, to be fair that isn't a problem peculiar to the upgrade, it's always happened, but is very offputting, so while we are tweaking it would be good to sort it out...

Over sized images were a nuisance with the previous format though werent they ?

 

I did try firefox which solved a lot of problems, but finally upgraded to IE8 now and life is so much easier :)

The green dot thingy should only appear if you have actually posted in that particular thread as far as I know.

 

That's my point, the two screenshots are of this thread, which I have posted on. The forum page shows the green dot but the New Posts page doesn't - just a blank space.
