Unicom changed t&c's - contract exit?

Hi,

 

I complete the monthly accounts for a very small charity. About a year ago, they were tied into another 3 years contract with Unicom due to a 'rolling contract'. It was disputed with Otelo but contract renewal was upheld. :(

 

With the change in terms and conditions, can they, as a small business, obtain an exit from the contract without any penalty charges being applied?

No. Changes to T&Cs are not reasons for contract termination. The best you can hold out for is a rejection of the term(s) being applied to your agreement if they happen to work against you.

 

The ability to end a contract early can be based on TARIFF issues, when they significantly impact (price wise) on the service you agreed to take.

 

However, most of these protections only apply to consumer contracts - business users are a different case, and they have to assert their rights directly. Simply using a T&C change as an excuse to terminate a pre existing contract probably won't get far, becasue if you push it, they'll simply say it is only NEW contracts from that particular date that will change.
