Wonga - Any point asking for CCA?

I've now got Barker & Lowe (Wonga?) demanding full payment.

 

Is there any point in asking them for a copy of my CCA with Wonga? Are they even

valid for payday loans?

 

If I do request one, are they allowed to file a default on my credit file whilst I'm

waiting for it?

Barker and Lowe are just another desk at Wonga. I always think a CCA is a pound well spent. Will put them on the back foor and make them realise you are serious. As for the default they probably can (not sure if they will). I have not seen their agreement tested for enforeability but there are other Caggers who are much better on this subject than me.

I was told CCA would make no difference as payday companies doesnt work that way! Was told that the online agreement you sign at the time is the true agreement...

You are still entitled to request a copy of the agreement, however since the Electronic Signatures Act came into force in December 2004, all they have to show is a copy of the agreement with a tick box !! (and obviously no signature)
