Hi all.

i'm new to this forum and just wanted a bit of advice if possible.....

I'm an Electrical Contractor and recently completed some work for a Builder.

On completion, invoices were submited.

Payment was made 30 days later via cheque....which bounced!

now Builder refuses to pay at all on a 'faulty workmanship' basis

Just wondered how i stand about filling a small claims form?

many thanks

See Blackstones on the cheque rule. At the point at which they raise a cheque there are two contracts, one for the services provided and one for the payment of the cheque. Assuming you haven't done anything to compromise your claim, you can sue on the bounced cheque rather than the underlying contract. This limits the other sides defence, they can't raise issues about the underlying services that you have provided.
