    • Capital assessments are based on the:   amount or value of the asset at the time of the application outcome of checks carried out to protect against fraud As with income assessments the partner's share of the equity is included in these calculations - unless there is contrary interest. Just found the above in the law society website.  So am I screwed.  So confused.   
    • I am bound to say that their alleged contract is probably the weirdest I have seen. Considering it is supposed to be a serious legal contract to set out the conditions under which CEL manage the parking on land that does not belong to them it leaves a lot to be desired.   For a start it does not comply with the BPA Code of Practice which is   7.3 a the definition of the land on which you may operate, so that the boundaries of the land can be clearly defined b any conditions or restrictions on parking control and enforcement operations, including any restrictions on hours of operation c any conditions or restrictions on the types of vehicles that may, or may not, be subject to parking control and enforcement d who has the responsibility for putting up and maintaining signs e the definition of the services provided by each party to the agreement.   So no mention of hours: no mention of types of vehicle restrictions: no mention of who is responsible for the erection and maintenance of signage   and much more serious -no mention that CEL have to comply with the BPA Code of conduct-that one is listed on 7.1.    All it states is that the operator can pursue outstanding PCNs in accordance with the COP but that is not the same as saying that CEL will abide by the CoP which it must say.   Also AFAIK the only entity that can pursue for trespass is the land owner regardless of what this quasi agreement says. There is also no mention of the financial aspect of the arrangement nor how the long it lasts and what notice is required for either side to terminate.     It might be worth writing [not emailing ] to Medburn Estates asking them to confirm if this is the only agreement with CEL and whether they think it right that CEL have not received planning permission for their signs from the Council rendering their signs illegal which is more serious than unlawful and therefore all PCNs issued are worthless and should not have been issued as it is impossible to form a contract with motorists when the signs are illegal.   Also that as CEL are their agents Medburn Estates LTD are responsible for the actions of their agents. You could also ask them to cofirm that the signature on the paper is that of their Director, Anthony Brown and whether their copy has a counter signature of a CEL representative.   Carry on that CEL are taking you to Court and as another Judge has asked a Landowner to appear in front of him to explain their contract, whether it might be in the best interest of Medway to have a serious conversation with CEL to avoid any possible  embarrassments in your  [ie Laluna] Court appearance.   I have not looked much at your WS though it is looking good.   I would have mentioned that as they failed to comply with  Town and Country Planning (Control of Advertisements) (England) Regulations 2007.   that they are in breach of their agreement CoP with BPA to keep to all the legal requirements in running their parking  operations.   It calls into question their right to apply for motorists data from the DVLA.   I would wait for their WS to arrive so that you can pick holes in that too. however watch that if they are late that you send yours off just within the Court guidelines.   What you are tying to do with your WS is to put your side of the case plus put CEL in as bad a light as possible for them to  decide that they don't really want to go to Court after all.

Hi - excuse me but are the FCA saying that they no longer support the idea that ERC's are subject to the test of fairness?

 

I am thinking that an ERC coupled with a MIG is belt and braces and a company that 'employs' both

and then sells the product 12 weeks later is really taking the ****, as in my case.

 

A MIG is a higher lending fee in another cloak in my own opinion, and if both of these are supposed to be to protect losses for the lender in some way,

can we ask the companies involved to show the figures and prove what they assert?

 

Take that along with their abuse in the libor rates plus additional charges and they really are just printing money.

 

I am still struggling to get any acknowledge from GMAC/Paratus on these matters and they just give me the usual guff about what they are allowed to do - e.g. get away with in this country.

I have recently had court dealings with LMC and the judge totally dismissed all their claim and threw the claim out of court-the reason was because of there underhanded and manipulated way that they tried to steer proceedings-they used bully tacticts and basically thought they were above the law-by 'removing the Acknowledgement of service' from the claim pack-sending a representative to my house asking why i had not returned the forms-and general nasty bully boy tacticts-the judge made them remove all court charges from my account and pay me £350 in compensation-stand up to them they are not as bright as they think they are. (And that's pretty dim)

 

Also if anyone needs a solicitor to act for them with this underhanded shower-at reasonable costs please let me know-I can recommended an excellent company who are more than happy to oblige with this underhanded lot. Please inbox me if needed.

im still fighting with blemain and today they have told me that they intend taking me to court.

Thanks for the update suffering, hope his nightmare with them is over now! Did you have problems with them to, if so how did/are you getting on? I've started a thread as I'm about to take them on and to be honest, im dreading it!

It’s easy to say blemain charged me £35 for a letter or phone call and that is unfair. But why is it unfair, what makes it unfair?

So if someone would be so kind and post-up a list of what Blemain charged then for, then we can start looking at the terms of the agreement and the relative rules that apply.

hi blemain are not allowed to charge fees constant now for ringing you 35 pound a time its now at most one a month 35 together have said i think he said they have stopped it happening,but this is still crazy, claim it all back hun through support team that together now have, put a complaint in and dates you may be shocked how much you get back hopefully just be careful because they stuck interest on also so dont fall over when you get that shock too and yes about your loan and others the same there are quite a few hun that were not dealt with right im fed up with the trauma trying to chill but am hateing seeing so many customers of blemain all left in a pit and we should have been out the pit yrs ago.

just here to say hello

 

just a quick update after 9 years fighting blemain I thought me and blemain had come to a uneasy peace but its back on

 

blemain removed every single charge from my account

 

blemain removed all insurance charges from my account

 

blemain removed all interest from my account (intrest free loan )

 

but I made a mistake

I let solicitors add the point about brokers fees being unfair and I couldn't prove this point

 

the same solisitors put phone harassment into my defence and I couldn't prove this point either

 

so I ended up with some costs

 

so me and blemain are back on

 

I will start a new post and give you all the details

Hi suffering

I went to court with them.

But like a fish they wiggled and squirmed and got away, but like any big greedy fish they came back and now they are hooked again, and this time I have learned how to play a big fish.

I did end up with an interest free loan

Hi Welshperson. Like you I am back on with these bullies but from an unregulated contract. I am going to trial with Together (LMC) and I have been to court with them numerous times and won. think it would be beneficial if we shared notes etc. Please let me know.

Hi i was just so upset this morning and struggling with all this torment over my loan with them ongoing and saw an email showing you in same boat as me and your message, it made me feel im not alone i know there are more of us, but seeing what you write made me realise i need be strong. Thank you 

 

The Judge said at last hearing if no settlement sorted, he would multi track my claim and move to a bigger court out of area, well he kept his promise thats just what he has done.

 

I have to travel in under 2 wks now and hopefully my son too to a meeting. I know this mess could be sorted now and end to it all.

 

Sorry forum for not on own post i felt to quickly reply to this one, i will go now back on own post. 

The stress level is unbelievable. I keep having to do little things to refresh. Im trying to talk to Together to sort this out now. Health is important more than money and happiness i need an end to this as this battering is so exausting indeed, its exausting mentally and emotions you are up down up down with the stress of it all, im believing better days soon.

The stress is horrendous, i took ill and landed in hospital for a couple of months, due to the stress of all this i decided to drop my fight for the sake of my health and paid it in full. In short 5k loan i paid back £21,322.38. 

On another note though i got an ambulance chaser call me regarding blemains hidden commision to broker and she was telling me they have had lots of success against blemain (together). I may look into this one day when i feel ready to do so.

Thank you for your reply. Over the years I have read horrendous stories of just what this sub-prime underhanded no scruples lender do to people. They do not give two hoots about their customers it's all about squeezing as much money as possible from them. Time to fight back. Don't give in.

? My claim certainly does not involve an ambulance chaser. I am hoping that it will set a precedent. I am writing a book about my experiences. Time will tell.
