      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi logbook loans sent a recovery van for my car and i happened to be in the window when he came and blocked my car in the driveway, i went out to him and made him move it, then i put car in my sisters. i recieved a call from the police saying it has been reported stolen, i informed them the car was mine and there was a dispute over money owed making the matter civil, the police asked where i was and could i come in, i then rang my sister to tell her to move car, the police must have traced the number i called (my sisters) and turned up mob handed dog van 3 cars and a van. they then took my car and asked where i was because there is now a warrant out for me, i have stayed out the way cause it was a weekend, i am going to walton lane police station on monday morning. i asked logbook loans on wed gone to send all paperwork they have of me, they did this immediatley minus the bill of sale. can anybody advise me what to do or say in police station. i have had no papers from court but my address sa been changed without informing anyone plz help i'm panickin here thank you

Hi Bud, Don't Panic, you will need to surrender yourself to the police, but first get hold of a sol, and advise him of whats gone on. Then go to the Station with the SOL, and get him to tear them a strip....very unlawful.

 

You own the car i take it, you have insurance, logbook etc etc, take them with you. Once the police realise that the LBL kno*bs have lied they will be give both barrells- inform the police complaints-don't be fobed off..

 

Next SAR LBL-keep the car hidden and on PRIVATE LAND...not at work, road, tesco's car park. They cannot block the the drive...

thanks trooper, lbl have my logbook, but i have my insurance details. the police got the car takin away as they said it was stolen. will ring solicitors now and go there i'll let you know what happens

Yeah CaB will help, it;s just that they might not see you today as they are very busy... Give them a call, you can also get free legal advice if you are on benifts from National Debt Helpline, they have legal advisors, they may be able to help over the phone.. You really need a SOL and get yourself down the Police station, they police will come back...

 

Question, why has LBL got you Logbook? they only need a photocopy... Did you recieve anything from the DVLA about change of owner at all?

the log book is what they took, i've just been police station after waitin for an hour while the seargent looked at my case she told me to come back at 3 o colock to be arrested, and answer questions about why i removed vehicle from my path when lbl had seized it. i can't get solicitor till morn so i will attend police station on my own. what can i say. thanks for the help by the way

Ok, no problem...

 

When you go back state the following in the interveiw room.

 

" I (your name) freely, by my own occord have handed myself in peacfully to make a statement on the accustations presented to me" say it when they tape.-this covers your a*se, as far as the Police are involved

Rember you have done nothing wrong...

 

If they arrest you ask for a duty SOL. you have that right.

 

I suspect that as they have asked you to come back they already know you are the owner...

 

Purly Speculation

They may try the Breach of the Peace bit, but IT WAS ON YOUR PATH, so the Police are powerless, Civil Case, so they need a Court Order to remove it, or YOUR PERMISSION...

 

Be honest is the best policy here...

i got out of station at 10.20pm i've had drug test finger print photos dna the lot. in the interview the police said the got a call of lbl who reported my car sttolen. they said there debt collector clamped my vehicle on my drive and when he returned i took the clamp off and drove away. the police had a default notice termination notice amongst other mail all of which i have not seen before. they also had a photo of my car with the clamp on. i told them about this website and all the underhand tactics they use and this is a civil matter, lbl have broken numerous rules so i have reported them to oft, the police were intouch with cps, they released me on bail to appear back at station on 10th september, while the evidence is looked at in more detail. they agree it is a civil matter, so i asked what about my car then surely i can retrieve it in police compound. i now have to get the policeman who arrested me see what he says.

Hi phelo. i am 20mins from were your car is. and i could show walton police some paperwork were they would have to return your car. but i am going to ask you some questions first. and please be honest because some things do not seem right.

 

1. have you made any payments since you took the loan out to logbook loans. ???

2. have you been charged with theft of a car ( dna/prints/photo) can not be done until charged.)

 

 

can you please post up your bill of sale as soon as you can so as i can look at it.

hi they arrested me for suspicion of motor vehicle theft did not charge me, bailed me till sep 10, i have paid about 4 or 5 payments, i can meet u there if you want i have docs on me now and i put a link on previous page i hope u can help

Phelo. you need to get yourself a solicitor. there are problems with your bill of sale. but you have not paid anything since you took the loan out. you have had letters from wondsworth court and also a repo order was granted.

 

they are many good people on this forum that will help you fight lbl and fights are getting easyer (more and more are getting there cars back) but you are going to find yourself with a case of fraud. you have not made any payments/ you have not replied to the courts/ and you have not made any contact with lbl)

 

please go and see a solicitor and be honest with them from the start.

i have made payments even police had invoices of payments of lbl they didn't give me default notice, at address of car. surely something can be done, is it worth going to arresting officer asking him bout car, its still in police compound.

Right, here we go, The POLICE are Wrong, they have acted unlawfully, you NEED a SOL TODAY.....YOU have been held illigally....This is a civil matter, full stop.

 

 

Please make a compliant to the Police complaints.....It will streagthen your case, the car was taken by the police and is being held by the pound, now here's the kicker The BoS looks complete, But here'e the problem..... The default notice needs to be strict proof and as you have not recieved it makes the BoS VOID see point 5 and 6 (on your BoS), so they HAVE to rely on the CCA, which they need a court order to sieze, hence the cars was taken unlawfully, your arrest unlawful, Add to that, the Police have copys of documents from LBL that you have not recieved? I would seriously question the valididty of the paperwork..

Did you see a duty SOL at the station? did you ask for one?

Where is the CCA 1974? Did you recieve it?

 

So summing up here, it looks like the car was siezed illigally form your property, without a court order(as the BoS default letter never recieved)and you have been arrested for Theft by the Police on the basis of a few letters (that you never recieved) and to top it off had the car taken by the Police act like repo men for LBL...

 

I'll flag this with other caggers to get them to look in and advise you more buddy....
