    • It definitely has to be 100% or they have pulled a fast one on you - even before the govt clarified on this I found advise to this end that it has to be pre-furlough pay.

    • ok, bit more info i should have stated. The claim was started within the 6 years stat limitation. the hearing was after 6 years had expired and so was the strike out. It is now 8 years past default notice, and i have not heard anything since strike out for 1.5 years. surely another claim for the same terminated account is timebarred, even if they change the amount to a lesser amount.   the issue is the oc bank has written to me stating i am due a refund of wrongly taken charges and interest FROM 2011 and have applied the refund to the os balance, which is with the purchaser company who was struck out. The oc say they have informed the purchaser of the revised balance, which means the claim against me by the purchaser was for the wrong balance. surely this does not mean thy could use this balance for a new claim 8 years later? this smells like a trick.

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Company has stopped my Statutory Sick Pay

Hi all

 

First up, I need to admit that I have a bad sickness record at work. My % in work is roughly 65% for the last 12 months as a mix of sickness and Crisis time.

That time includes about 3 and a half month sick with Stress & Anxiety and 2 weeks Crisis after my little nephew died suddenly.

On top of that I have had a few illnesses and periods where my IBS has left me in a quivering wreck.

My last illness was about 6 weeks ago due to my IBS and I was given a Verbal warning as I was already on an Improvement Plan (We get a 6 month improvement plan, a verbal warning for 6 months then written for 12 and final written for another 12).

Now, as of Tuesday I have been off sick for 4 days with IBS which has been inflamed by my medication for Tennis Elbow (yes, I am a wreck).

My boss called me today to tell me that the HR department had decided to stop my SSP which came as a surprise as although we were TUPE'd about 3 years ago, my Sick Policy prior to TUPE stated I am entitled 130 Full Days and 80 Half Days sickness.

As it stands, I am likely to be returning to work in a few days (rota'd off now for a week) so there will be no more sickness from today.

I have no more information yet as they are sending me a letter tomorrow and wont have it for a few days but I was wondering what people's impression is of this?

Do they have any grounds upon which to stop my pay and more importantly do they have any grounds to fire me suddenly, irrespective of the usual process as listed above?

You'd need to check your contract to see if there are any conditions attatched to the Company sick pay scheme.

 

Although you could potentially be dismissed on capability grounds, they couldn't just do this suddenly. They'd have to follow a process to do this. Have a look at your Company's disciplinary procedures to get an idea of the process to be used.
