    • Hi LFI, With regard to the ANPR cameras in your post #65, while I was on the phone to the Planning Department, they did take a look at Google Streetview and went back to 2012 where they could see the ANPR cameras in place so therefore they would have deemed consent. I had previously read the T&C Planning Regulations and had read the section on deemed consent so I understood the point they made on the phone. It doesn't matter though, that doesn't harm my case any, and I shouldn't really mention this now, (this is what you reminded me of on another thread) but in the past I was a member of a scheme that gave me access to legal advice, I have spoken to a barrister previously through this scheme on another matter and I think I am still a member. I am going to check if I am still a member of the scheme, and if I am I will discuss my case with a barrister or solicitor, whichever the scheme deems appropriate. I will let you know the outcome. I am also going to take Bankfodders advice in the sticky and go to the local court and ask if I can sit in on a case in the Judges office.
    • deed?  you mean consent order you and her signed? concluding the case as long as you nor she break it's conditions signed upto? dx Yes sorry. they called it a deed at first in court.  Then Judge said she was happy to have it sealed as something else  exact names of orders in message above.     The disease was tested for when his cardiac testing was done immediately after purchase and part of the now sealed case.   However, results were disclosed incorrectly and I only found out  two days ago.   This disease did not form part of my knowledge during the case as I had been informed of a normal result that was not the case.   it is perfect clarity of a genetic disease where as the previous cardiac issue could be congenital until the pup is genetically tested. 
    • Hi, Halifax recently sold a credit card account of mine to Cabot. I am unemployed and have no assets and was thinking of making token £1 payments for 12-18 months in order to drag things out a bit and reduce the chance of Cabot being able to get the correct CCA documents from Halifax if I requested them in future. However, I saw on the pages on this forum about defending county court claims that one of the standard approaches when defending such claims is to say “I had an account with bank X, but I don’t remember the details and so don’t know if I owe this debt…”. If I made £1 payments to Cabot, would it prevent me from using such a defence in future? OC: Halifax DC: Cabot/Wescot Card account opened: 2016 Defaulted: 2023

    • Hi, This may be the wrong place for a thread BUT If you receive a defence, can you send a CPR 31.14 request for document mentioned in the defence, and then apply to proceed with the case only after (14) days passed or they respond OR is it only if you receive a claim I see @dx100uk thread is for when you receive a claim, but can you also do the same when you receive a defence?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

(the italics bits) This thread was always a very good read, but I can't do it any more with it looking this way! - I've tried the 'Ctrl' plus scroll wheel which makes it bigger, but still fuzzy on my PC's LCD - there wasn't a problem before! I hate it. - If you can't read it, what's the point of the site?

Where's the UserCP button? When half the forum are feeling uncertain as it is over the mass exodus OTR due to the PT issues and Cabot6 stuff I am utterly amazed this has been done.

 

This is like the Swift group forum I go on. Nobody tells anyone what is planned or is going to happen, you just get "fait accompli get on with the fall-out." If I'd run my business the way many act on here it would have dived years before it did through no synergy at all. It's like the management here are on a self destruct mission. Amazing. Comfort zone dissappeared. At least when you know your way around you can guide others. Reminds me of ants running in a neat little line knowing exactly where they are going and then that line blocked and they all run all over the place. Barmy!

The changes have been in the pipeline for a long time it has nothing to do with any mass exodus.

As with anything new,it will take time to adjust and there will inevitably things needing tweaking.

why fix what ain't broke

 

People always come out with this classic quote when something changes. I don't know why people are so against change, improvements can be for the better and keep things fresh, up-to-date and relevant.

 

To illustrate my point, this is how eBay used to look once upon a time, does anybody honestly think that it was better as it was and didn't need updating to how it is today?

 

Why don't you give it some time to get used to the changes and see how you find it before complaining? I'm sure the changes were implemented after much careful consideration.

Sometimes you need to look beyond the aesthetics and the reason why were all here, someone needs help and advice to get back in control of situations, the knowledge and experience

the folk here have is priceless, that is awsome in these difficult times.

 

I prefer how the old search results were displayed, but at the end of the day it's the info thats important.

Martin, I will be totally honest (as usual) and I admit after having a few hours to play with this, it is a lot better than it was when I opened up my screen this morning and found a completely different forum to the one I left last night. It does take some getting accustomed to and no doubt the changes will be embraced by the majority and everyone will get back to their own particular issues in time.

 

However, as with any changes some kind of warning might have been made prominent to users who, as some have pointed out, have immediate worries they are facing and were dealing with. To come in this morning to be faced with all this has been, even for hardened caggers like me, somewhat of a time taking exercise to get through.

 

I cannot speculate on the exodus and do not wish to, but even if 15 - 20 have left, look at who those 15-20 are. That is where the numbers game doesn't come into this. There's no benefits in airing dirty washing, but you know as well as I what I'm talking about and for people like myself and my long relationship with Cag, that is unsettling.

 

I will continue to support the forum for as long as I can because, like yourself, many have been very supportive to me in my own cases and I don't forget that.

 

I still think the change is cold, but I am a mere number in the sum of 1.

great bit of sarcasm, barracad - very helpful indeed and extremely insightful, no doubt you have been working on that one for some time. I'll return the favour by thanking you for your ever-so-helpful input on the matter....oh to be you and have the power to find old formats for various websites and create links to them. One can only aspire to reach such lofty heights.....

 

I am simply expressing my OPINION that I do not like the new format. Nor do I like the fact that there is no obvious explanation of the various changes, particularly to the most popular features of this normally superb website. There may well be such an explanation somewhere but it is not obvious to me or from the looks of it, many other Caggers.

 

As you point out, changes can be good but this does not entail that they are good or that they have been adequately communicated to the site users.

I don't like the new format either :( but no doubt I will get used to it...happens all the time on Ebay and Facebook! Thank you to the poster who told me how to find my subscribed threads..I must admit to having a slight nervous breakdown over this earlier :D sorry to hear that people having been leaving, i've always found this site very helpful, don't know where I'd be now without it!

 

P.S Could we perhaps have it in pink :D much softer colour lol

I can see the advantages of the new software in the near future. I must agree with andrew1 though. If this has been in the pipeline for some time, there should have been a notice somewhere on the site to let users know of the forthcoming changes. Even the Water Board let you know when they are turning your water off to do maintenance. And they couldn't give a flying f*** about you.:p

 

 

If all else fails, kick them where it hurts and SOD'EM;)

I was horrified when the site first changed as it was awful. I have been checking in over the weekend by iphone and have struggled. Today back on my lappy I am pleased with the way the site looks. There are still a few bits that need tweaking but it is getting there.

I must admit, this is now hurting my eyes to read for any length of time, unlike the previous lay-out. It appears Webby is working hard to tweek it so hats off to him/her, but overall the whole forum has lost that community comfort zone feeling it always had. I know it's not going to go back to the way it was and I've been trying to get used to it, but I have enough other things going on in my life just now to concentrate on and this is like just another learning curve I could have done without.

 

Sorry, but overall? - cold. Don't like it.
