Hello there

 

I have recently been contacted by hfc with regards to a final charging order being enforced. The debt is for 32,000 on two amounts and the debt is solely in my fathers beneficial interest.

 

We are joint owners and not tenants in common. Do I have to pay these before I cantransfer ownership from my father or do I justhave to notify land registry that I have got my solicitor to inform hfc that we are transferring.

 

The house is now a family home as was recently married and my father is no longer living at the property. I pay themortgage and am concerned that a order of sale can be enforced.

 

I spoke to mysolicitor who says all u need to do is notify creditors of transfer. The property has restrictions but are these full charging orders as hfc is wanting to enforce their order and there is equity in the property.

 

Please can I have some advice as to my next posititon.
