Hello ,I unwittingly cashed a cheque at a cheque clearing centre, that subseqently i was informed by a company called Transax that it was counterfeit. After all attempts to get hold of the person who gave me the cheque, i was told i was responsible for paying it back in full, as i recieved the funds. (The funds were used to bills etc). After weeks of worry and trying to get some funds, I eventually paid nearly half the amount back, but now cant afford to pay the remaining balance. I have today been told a county court summons is being issued prosecuting me under the theft act of 1978 !. I have today offered a weekly payment plan but Certegy wont consider this, as they say its been passed on the relevant authorities who will issue the summons.

Is there anything i can do , and what happens with a county court summons?

A county Court is a Civil Court.

Matters arising under the theft act would be dealt with by a Magistrates criminal Court or Crown Court.

Who paid the Cheque ?
