      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

Payed 223,94 pounds for a book through' Amazon.co.uk 'to 'prima_books'(also UK) in october 2009.

No sign of the book and since december 2009 impossible to contact "prima_books".I just can't find any address or phone number.

Nothing on 'Google' and nothing in the 'Yellow Pages'.

No help from 'Amazon' , stronger they refuse responding further e-mails.

My only 'thread' was 'dee@prima_books '.

So before taking legal action I would like to try to solve the problem with 'prima_books' themselves.

Before you part with any money, do your reseach, even though it's through Amozan. Raise a written complaint with them - Amozan.

 

I've send an e-mail to Prima Books .

I hope they are the one I am looking for.But they seem to be specialized in books on laser techniques.Mine was on antiques.

Mine is located in UK and uses 'prima_books' with underscore.

The mail I've got from them is signed by 'dee@prima_books'.But this address does not work anymore.

yep BankFodder,

I payed by VISA, they advice me to try to settle with seller.

The amount went on 16 oct 2009 to Amazon.co.uk but they won't reveal the end-beneficiary.And they DO NOT bother to poke 'prima_books' to answer my mails.In the mails I've been sending through 'Amazon' they erase my e-mail address. ttttsssss

Yes 'Amazon' found a book I wanted at 'prima_books'.

The idea was to try to search for the e-mail address of 'prima_books'.If I do not succeed I am going to explain what happened and how Amazon tries to fled from helping out.

if you have any correspondence at all you need to see if they are on company house website, limited companies only, or go on company house website and type the name in, and area, if you know it, and if you have the company registered number type this in, will give you their address and if still actively trading, amazon should be able to help more on this, see if they have their company registered number, etc. hope this helps.;-)

Thanks I'll try those possibilitys.

Amazon.co.uk is of NO help at all.Their supervisor in Cork mailed me that they won't answer mails ' regarding this issue'.The mails I've send to 'prima_books' were through a standard form on Amazon so called 'contact seller' link.But were never answered in 2010.

Contacted 'primabooks.com' : not them.

Googled the name in different ways : not found.

Tried 'Prima discount books ' : not them.

Surfed the Yellow pages with different possibilitys : no result.

ALSO, have you rang your bank, get the details off them where the monies went to, and see if they can tell you anything about the address where they went, or is it just amazons details?

also if you paid by debit or credit card ask your bank what they can do for you? HAVE YOU ASKED THEM AS YOU DO HAVE rights if paid by card,
