      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Between my husband and myself we have run up loads of debts on credit cards to try and keep his business going. Now we cant even make the minimum payments on many of the debts and its getting worse. Before all hell breaks lose I would like some info on what to do about contacting the credit card companies (probably every one) and HSBC.

 

Virgin rang today and I gave them a small payment but they said if I had problems they could freeze the interest and agree a repayment plan but would stay on my credit record for 7 years. Firstly is that wise and correct - why have they offered it first before I said something? Is it a trick? (Have one missed payment which was paid today).

 

Most of the credit cards are via MBNA bank (+ Egg & HSBC). Think all have been opened online. Not bothered about credit records now as they are "poor" anyway but what is the best way to try to proceed to avoid paying more interest than repayment and end up going bankrupt???

 

I have looked around the site for 2 hours but just cant seem to find the answers. Should I first look to see if the agreements are enforceable as it states in many posts???

Sorry for not knowing but what does CCA mean???? I seen somewhere a list of abbreviations yesterday but cant find it again today?

 

If it means getting my application forms from the credit card companies will that put them on alert to my account?

you dont want the application forms....thats NOT an agreement

 

you want a copies of your Consumer Credit Agreement

from everyone you are paying.

to check they have the legal right to demand money from you.

 

put them on alert? to what, you getting wise you've been fleeced?

 

its your legal right to see these documents.

Hi DX100uk, thanks for that reply.

 

1) Is there a letter template for requesting the CCA?

 

2) If I have several CC's with MBNA can I send one letter requesting the info or do I have to apply for each CCA separately?

 

3) Whilst looking around the letter templates I came across one to get your charges back if you are on benefits. I had to pay C&G £30 this month for a missed mortgage payment and the CC companies are applying late payment charges more than I can ever clear. Am I allowed to ask for these charges back if on benefits (I do actually get Working Tax Credit as well but dont work anymore myself)?

 

I do plan to sort my mess out now no matter how long it takes.

yes there is a cca templte letter

look in the template library or on our homepage

 

i cca per a/c regardless to whom holds it sadly

 

it does not matter if you are on benefits or not EVERYONE can reclaim unlawful charges.

 

what i would do is start a thread for each of your 'quests' in the named forum for that co.

then you and us can keep track

 

as for those mortgage claims, c&g are very good at fleecing on that too.

 

off you go and get reclaiming

Afraid i have fallen at the first hurdle, I have spent 2 hours trying to find the CCA template without any luck. I have been all through the library - could I have a direct link to it please as I just cant go any further.
