Help. My partner has just received a letter from Mackensie Hall Specialist Debt Recovery and Trace Solution Provider.

It looks like a standard letter that they would send out to anyone with the same name as it says they are attempting to contact him regarding a personal matter and request him to get in touch.

There are no specific details on the letter just a reference number for them and a client reference number so we have absolutely no idea what this so called debt is for. He cannot recall ever having owed money that he has not been chased for or already paying back.

What should we do? If we contact them to find out who their client is they will only take that as an admission.

Please, some advice would be greatly appreciated.

ignore it until something more conclusive comes.

I have no legal training, any knowledge I have has come from this forum, and my own experiences. Always balance up any advice you get with your own common sense.

Ignore Mackenzie Hall and if they continue to send you letters report them to the OFT and to your local trading standards office. You could also report them directly to the East Ayrshire Council trading standards. They know all about this company.

I would concur with the guys' posts - ignore them. If, however, they do follow this up, it would seem very reasonable to send the letter template saying that you do not acknowledge the alleged debt.

Dear Sir/Madam

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

I am/we are familiar with the CPUTR 2008 and the Office of Fair Trading's Guidance on debt collection, which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. AND in not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to Trading Standards and also inform the Office Of Fair Trading of your actions.

I/we look forward to your reply.

Please note, I am not professionally qualified in legal matters. Should you have any doubts, you should contact a legal expert.

However, I can and will help with matters regarding payroll as I am fully qualified.

They're phishing, ignore them altogether until they can write to you direct with your name and the nature of their enquiry.

I would send them nothing, not even an acknowledgement of their 'card through the door' until they can provide you with more information.

If they do that then come back here and ask the same question again.

I reside in Dawlish Warren but am not a rabbit.
