had a loan with ge money ppi was added to account without salesperson even asking whether or not it was required and have been trying to claim it back from ge money..however they are now saying it is not their responsibility because they never sold the policy nor were they present at the point of sale, despite the fact of course they collected all the premiums that were paid over the lifetime of the loan...they are blaming 21st century finance who conveniently no longer exist...any ideas where to go from here...have already told ge money that if they will not pay out i will issue a court claim...however does everyone now think this is gonna be the only course of action seeing as ge money deny responsibility?

Hi Debt4get,

I believe you may actually have two options available to you now.

1) Register a claim with the small claim court.

2) As GE money have investigated your claim and denied it you can now refer the matter to the Financial Ombudsman Service ( FOS) and ask them to investigate the claim on your behalf.

In my personal opinion the benefit of the FOS is that it does not cost you anything for them to take on your case, but they will charge GE money £500 for investigating.

However the FOS are handling a large number of complaints and so it may take quite some time for them to deal with your claim.

I suggest you contact the FOS by phone and seek advice from them. They can begin to register your claim over the phone and then send the necessary paperwork for you to complete and sign. You will also have to return all correspondence between yourself and GE money on this matter for the FOS to investigate.

The FOS website is Financial Ombudsman Service and their phone number 0800 0 234 567

Good luck

DJ
