Basically my girlfriend has paid £400 deposit on a place she has not yet moved into and has signed no contracts for.

She tried to stop them taking it out but they said it is non-refundable.

I am telling her to phone them tomorrow when the person who deals with deposits is in as she was told they wern't there.

She assures me she has signed no contracts.

They can't legally keep it now as she has found a cheaper place with me to move into.

Looking for advice on what to say to them. As far as i am aware they cannot keep a deposit if you don't even move in or sign any tenancy contracts.

Desperate for help here.
