    • I would stand your ground and go for the interest. Even if the interest is not awarded you will get the judgement and the worst that might happen is that you won't get your claim fee.  However, it is almost inevitable that you will get the interest.  It is correct that it is at the discretion of the judge but the discretion is almost always exercised in favour of the claimant in these cases.  I think you should stand your ground and don't give even the slightest penny away Another judgement against them on this issue would be very bad for them and they would be really stupid to risk it but if they did, it would cost them far more than the interest they are trying to save which they will most likely have to pay anyway
    • Yep, true to form, they are happy to just save a couple of quid... They invariably lose in court, so to them, that's a win. 😅
    • Your concern regarding the 14 days delivery is a common one. Not been on the forum that long, but I don't think the following thought has ever been challenged. My view is that they should have proof of when it was posted, not when they "issued", or printed it. Of course, they would never show any proof of postage, unless it went to court. Private parking companies are simply after money, and will just keep sending ever more threatening letters to intimidate you into paying up. It's not been mentioned yet, but DO NOT APPEAL! You could inadvertently give up useful legal protection and they will refuse any appeal, because they're just after the cash...  
    • The sign says "Parking conditions apply 24/7". Mind you, that's after a huge wall of text. The whole thing is massively confusing.  Goodness knows what you're meant to do if you spend only a fiver in Iceland or you stay a few minutes over the hour there.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Been trying to fix my credit rating before i apply for a mortgage...

 

There is a default ( will expire at end of year, but i need to apply for mortgage soon) from 2004 even though the account was handed over to Advantis Credit and i paid AC in full some time ago.

 

I chased and chased vodafone about this over the last few months, CS cant even find my account - i dont know the mobile number anymore - but have given the address that the default was registered at - EVENTUALLY was told to fax the Quality Assurance team but have heard nothing back! and quite hilariously they dont have a phone number!!!! how can a PHONE COMPANY department dealing with PEOPLES CREDIT RECORDS not be contactable by PHONE??? what are Vodafone thinking??

 

Anyway due to the rudeness of EVERY telephone rep ive spoken to, ive decided to stay with t-mobile as i was going to switch to vodafone when my t-mobile contact was up but thats not going to happen now - at least tmobile will answer your phone and do their best to sort problems - vodafone just doesnt want to know! shame :(

 

So is it true that the QA dept dont have a phone number? how do i contact them to find out they have even recieved and are dealing with my request? and is there any other way i can get the default removed? i have proof that the AC account has been settled in full....

 

Any ideas guys??

The Vodafone Web Relations team should be along soon. I'm sure they'll sort both of your problems out quickly. They have a good track record :)

not holding my breath - this lee person is on leave and i doubt anyone else will take ownership of the issue - afterall handballing is vodafones favourite pasttime. i think this Lee person deserves a medal if he actually does what the rest of the CS should do and take ownership of an issue until it is resolved..

I sympathise completely, DX - I spent an hour on the phone with them on Saturday and I was passed around 4 different departments. One of them actually hung up on me!

 

Dealing with Vodafone has consumed my life for the past few weeks. I'm holding off applying for a mortgage as well, just because of VF's mistake. I don't think they care or realise how much it affects their clients' lives...and I was their customer for more than 9 years!!!

I first contacted Vodafone about this in MAY. and its taken until last week to even get the QA fax number out of them! for a while they kept trying to put me through to Agency Liason, tho then would pass me back to collections who would then pass me to CS, who would pass me to AL and so on and so forth. And a different story every time. Today, after i was told by AL that QA are an 'adminlink3.gif team' ( but she couldnt explain why an adminlink3.gif team didnt have phones ) and for that reason i couldnt call them... i called back CS and asked to be put through, but the CS adviser told me they are closed??! and even put me through to a recording saying ' welcome to vodafone, this dept is closed'

 

Now come on vodafone which is it???? and WHY WHY WHY do the 'adminlink3.gif team' not have phones? the admin team where i work are most certainly contactable, what makes VF so special???

 

Ive sent off an email to the webteam, but it seems this Lee person is the only one who does anything so i guess itll be another week before i hear anything :Cry:

Yes instead of hanging up on me i would normally get put back through to the number tree and told to type in a mobile number i no longer have haha. Just press Hash to get through that it seems to work. I just dont understand why none of their CS departments were unable to explain WHY the QA team dont have phones and apparently neither us or the CS teams can get through without post/fax - how on EARTH is this acceptable in this day and age? My issues aside, i would LOVE to hear an explanation from Vodafone.

 

My work is currently a big Vodafone user, however our BB's are due for renewal soon, and im currently testing HTC Desire and tmobile against vodafone/BB and if the CS is anything to go by, i k now which operator i will be recommending to my managers...

As you've already emailed us you should now have an email reference number when you received our automated reply. Could you post it in the thread and I'll get this looked into for you?

 

In the event you didn't receive an automated reply just PM me the email address from which you contacted us and we'll try to find you that way.

 

While it's true to say that our Quality Assurance Department aren't customer facing I do work closely with them and can assure you that if they've received your fax they will reply once they've investigated your concerns but by tracking things this way I can make sure they've received your query.
