    • probably one of the freeman of the land 3 letter syndrome twaddle companies that have been popping up on facebook of recent.   there was a rather large d-live conversation resulting from one of them if you followed the rabbit hole links on facebbok whereby the two main protagonists behind most of the adverts in various fake company names  claimed they had got the rankines case over thrown and you could now win by following the old twaddle. it got removed over xmas.   as for dealing with the defaults...1st i hope you've not settled these to DCA's have you?   if the defaults were a true reflection of the way you operated the accounts (bar the one you claim in not yours...more later) there is little you can do sadly, though appealing to the better nature of the original companies whom registered the default sometimes works esp if you settled the debt with them not a DCA.but why would they have sold it if you'd settled the debt. sadly i think you've been had blind if you've paid any DCA anything .   as for defaults preventing a mortgage got to a proper broker that knows his onions,  2 are settled so shouldn't be of an issues 1 you say isnt your ...tell us about  one is with lowells now and unpaid...whats was the debt and with whom.   we have known people to get a mortgage with 5 defaults here all from 2018/9 period without having to get done over by a high rate of interest. in this current climate it should be easy now to get a mortgage...

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
      I opted for mediation, and it played out very similarly to other people's experiences.
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

I am confused about the situation between Frederickson and Egg - according to Egg, Frederickson are their collectors, and BC is a part of Frederickson.


According to your post, on the POC it states that Egg are the Claimants. I suspect Frederiksons were appointed as DCAs & BC have now taken up the legal cudgels.

I do not know what is going on but I went to submit my defense on the MCOL site. Once logged in, it is saying either my claim number or password is incorrect? I have tried and tried and tried to resubmit it but it still claims it is incorrect - the thing is, it's not! As a result had to post the letter on Friday but I do not know why it is not accepting it.


If they stopped the claim would this result in being unable to use the claim details? (because that is the only thing I can think of!)

Sorry, don't know the answer to that one Annubis. Suggest you phone the court on Mon & ask if they have technical problems & if not, why is your online submission not working.

Assuming this has come from Northhampton county court, the very first thing you need to do is acknowledge the claim online asap and state that you will be defending the claim in full. You need to do everything within the stated time limits or you run the risk of BC sneaking in a judgement by default, without you realising.


So what can be done if Carter has managed to get a judgement and the first you know of it is, when you receive a Warrant of Execution Notice?

Mark, it was my defense I am trying to submit, I already sumbitted the acknowledgement previously.


Wilchy, there is a section for me to import my documents, but nothing is working, it gives me the same outcome when I try to import:


"The following errors have occurred:

  • Claim number or password is incorrect."

I screenshot my acknowledgement of claim and registration when I did it, to prove that I have done those, and it is a good job I did!

Ok rang them, took over two hours to sort out, but managed to get it sorted, so that is the main thing! Thanks again everyone, especially Foolish Girl (you should change your name to Wise Girl) ;) You have been fantastic, I will let you know how it goes. :)

Did they explain why you couldn't log on? Is this a glitch that others may encounter? If so it would be helpful to know how to overcome it.

Hi, some how I had been registered twice in the system. I am not sure how or why, but that was the reason, so the double registration was causing a conflict. Sorry I should have explained. :!:
