CapQuest Statutory Demand

Hello everyone, I've been a member here for a while but this is my first post.

I will just tell you quickly about my situation, I have got into a lot of debt and have buried my head in the sand.

I have avoided all contact with people who have been chasing my debts for nearly two years and now I need to get stuck in and do something to get myself out of this mess.

CapQuest purchased my Sainsbury's credit card debt in December 2009 and last week I received a 'Satutory Demand' from CapQuest and was informed that they were looking to make me bankrupt, it was a real wake up call for me.

I came on here and found out that many others had received these demands too.

The letter that came was sent out on the 12th of July and I received it on the 14th of July by first class post.

As some of the other people have said, it is signed by Barry Davies who does not seem to exist.

So, to get to the point:

1) Do I have a chance of getting this order set aside by the court?

2) Should I have received a statement of my payments history and other details apart from the total amount of £1973 that is shown on the form?

3) Do I contact anyone to try and get a CCA and are some CCA's still classed as unenforcable?

4) Can I dispute this debt, I just stopped paying and never got in touch with Sainsbury's or Capquest to dispute it at the time?

 

Sorry for all the questions, I just want to get my life sorted out and stop the worrying after such a long time.

Theres no shortage of info regarding Capquest and SDs.

The best thing to do is have a read of these threads....its the best way of learning and digesting what you are up against.

You have 18 days for the set aside, but you need to act quickly is you are to have reason to set this aside.

 

You need to send either a CCA request tomorrow, or you could send an lba.

 

How old is this debt, ie, when did you take the card out.

 

Did this SD arrive by Recorded Delivery or 1st or 2nd class post, (hope you have kept the envelope!).

 

or

 

Was it served personally.

 

The information above is required to give a reason for set aside, you needed to seek help sooner, as you do not have that long to put in for a set aside with good reasons.

 

Hopefully someone with more experience will be along with more advice.

The only person entitled to your Personal Finance details is a Judge not a DCA

 

Move all banking activity to another banking group if you have a dispute - your funds can be used to offset debts within the same group.

Be careful with Banking details (card/account numbers) as these can be used to take unauthorised payments.

if the sd came by ordinary post then i personally would totally ignore it - as it has not been served properly and the first hurdle they would have to overcome is an explanation to the court as to why it was not served personaly/recorded or even at your work.

 

sd's that come through normal post are bluffs

Capquest have gone a little quiet now so think it is about time you reported them to the OFT if you haven’t done so already.

 

 

Please bear in mind that the template letter on the first page of this thread:

may not be suitable for all and you will have to adapt it to your own circumstances I.E

You applied to get it set asidelink3.gif and CQ didn't turn up

You applied and CQ agreed to discontinue

You ignored and CQ did nothing

 

 

Today the OFT set out some new guidance and sending SD's as a debt collectionlink3.gif tool is now frowned upon.

You can complain by email and the OFT will email you back a form to sign and post back to them for them to be able to add your complaint to their list.
