      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

I have had a very bad Experience with Log Book Loans, and would like to get some advice or some tips on what I can do? ok here it goes..

 

I bought an Audi A3 2.0 (2003) from this Guy in Swindon, he seemed like an ok guy and I really liked the car so I went ahead and purchased the car Registered the Car in my name and everything went smoothly even put my personalized plate on the Car and everything.

 

Now the thing is went I purchased the Car it needed a little work doing to it had been keyed really bad and needed a complete re-spray so the Guy I bought it off took this into consideration and knocked about 1K off the price of the car so I went ahead with the Repair and which cost me £1500 to get done and the Car was finally how I wanted it.

 

Now for the really ugly part.. About 3 weeks after getting the Re-Spray LBL / DG collections turned up without any warning and said they needed to take the car away as it had outstanding finance on the Car, however I had no warning or letters of them informing me that they were planning on collecting it, also not to mention I had owned the car for well over 6 months from purchasing it from the Previous owner and the Previous owner said it had no Finance or anything wrong with the Car (i even have a witness who was with me that can vouch for this) when they turned up in their 4x4 with a trailer attached they produced to me a piece of paper with the amount owing and that’s it. I was not happy and asked them to leave they said they had to collect the car and if I refused to give them the car they would have to smash the windows and drag the Car off my drive!! I was not having any of this. So I contacted the Police and they turned up, the Police at first said that they had no right to collect my Car and could not the debt collection people then argued between them saying that the BOS agreement or something allowed them to collect the vehicle, the Police then said that they were allowed to take it. Now obviously if the Police advise that they are allowed to take the Vehicle I took their word for it.

 

So I Agreed to this and the DG collections took away my vehicle. Now after doing some research they were not allowed to take my vehicle the police were completely wrong, the DG collections did not even have a Printed Copy of the BOS Agreement when collecting the vehicle I feel completed screwed over big time

 

 

Also what about the money I invested into the Car i.e. the £1500 re-spray this added Value to the Car and when they sold it they must of made a profit? as the damage was so bad (i still have receipts / proof of the work done)

 

I have all the paperwork and documents still but the Car has now been sold however I don’t agree with any of this and feel like there must be something I can do to get my money back surely?

 

Also.... After doing some research on the Guy who sold me the Car.

Log Book loans company gave a Loan to someone who has been caught for Multiple Credit Card Fraud and is a complete Criminal Surely they should of done some checks on this guy first to prevent him from even getting finance on the vehicle in the first place!!

Hi. you can do things but its going to cost you. if only you stoped them from taking the car first.

 

 

the main problem you are going to have is Did you do a HPI on the car. most solicitor now will not help if you did not try to protect yourself from the start. lbl or anyother finance dont have to register there interest on HPI checker but if you had done one you would have become an innocent purchaser.

 

 

the only thing you can do is go after the guy that sold you the car. but ou cant get him to pay for the respray.

 

 

also how do you know the car was sold ???

Oh how i wish i could turn back time and never of given the Car to them in the first place.. however whats done is done, I foolishly did not do a HPI check i know i have been kicking myself everyday..

 

Damn, but i would be Interested in the different options that i have as i dont mind paying additional money (within reason) in order to get some of the money back.

 

I know the Car was sold because i have spoken to LBL and they informed me that the Car was sold.

Hi CCTV,

 

Logbook Loans did give me the option to pay off the outstanding finance however because there APR Rate is 437.4 %APR it was something ridiculous
