Default notice has reappeared!!

Hi Everyone everything i get involved in is never straight fowards but if it helps anyone else.MBNA sold a debt to HFOS after 6years they both added a default notice no paper work from either.I complained to ICO and in 2008 they were both ordered to remove the notice from my credit file.Since then i claimed bank charges back and PPI.I keep an eye on the credit file through credit expert.I have a guy coming around to fix me up a mortgage this Monday,thought I had better check my file and theres a default notice added on the 18th,I have had no alert or anything and it is the same information that was struck off in 2008.I couldnt believe it!!absolutely devastated.I sent Experian a letter from 2008 they asked for but they still havent removed it despite promising to.

I ask anyone in a legal entity where do we go from here?I am sick of it!they are a law to themselves.By adding this information on again it is incorrect,outdated and clearly breaks the data protection laws.You cant argue the fact they just talk down to you!!WHAT can I do to stop this or who can I go to besides ICO who really dont have a clue breaking the law they should be punished,meanwhile it could cost me a mortgage:-x:-x:-x


MBNA £250 bank charges refunded.:lol:

MBNA claimed £2700 in PPI:lol:

MBNA default removed.

WESCOT balance written off no cca.

WESCOT default removed.

TIME RETAIL.default removed.

LLOYDS TSB.£150 charges refunded

MINT £220 charges refunded.

currently 4 in dispute unenforcible agreements.

HFOS ordered to remove default

YORKSHIRE paid token £200 PPI going now for full £600

Did you send the letter to Experian recorded delivery ?

What date did you send ?

Thanks martin this happened Friday talked to Jade at Experian and she said if I faxed the letter from 2008 from ICO the default would be removed Friday evening and checked today and its still there.I have sent 2 faxes to experian, fax HFO, 3 emails to experian and email and letter to ICO.But I shouldnt have to do this its old information.Trouble is I cant find all the letters from ICO from 2 years ago :-x:-x Only just decided to sort a mortgage out with my partner as house has been in her name for long enough.If you apply to these people for anything it is such a performance then these people can lie and ruin your life with adding a default,they dont even check to see if its truthful when you challenge it they bring another rule out saying they are entitled to lie!!:-x

Also,I know im spitting feathers here,I've had ICO send me letters and I've thought thats a joke its not right and told them so which has altered the decision.There should be one body set the rules follow the rules or your not in the business anymore.What bigger breach of data protection do you need to have than incorrect information on your credit file,HFO dont own the data it was put into dispute in 2006 without reply,its a joke!!

Yes I agree 100%

The ICO will have your case file-if you are stuck for copies I am sure you could get them.

Like you say the onus SHOULD NOT be on YOU.

 

I would give them a call on Monday and give them final notice.

 

You also need to be finding out just how these entries re-appeared.

 

I would put the DCAs responsible on notice that you will be taking this further.
