1--- (september 2009)

 

I have a letter from dlc(brackley) saying

This debt has been assigned to HS ltd, trading as dlc.

This means abbey nat no longer own your account and your account is now owned by dlc. All future payments and contact must be made with us

We will start reporting against your credit file within 30 days of you receiving this letter.

 

2--- (july 2009)-----Hillesden securities ltd are on my credit as

Defaulted:-o

 

How can this be:?: I have quite a few discrepencies on my credit file; and

feel like i want to start sorting them out.(1 at a time)

 

any help/advice "thanks" happyhamr:)

 

sorry also have letter from abbey (early september), saying that account

been sold to hillesdens:rolleyes:

 

should i just send copies to CRA:?: Quite clearly hillesden should not be on

credit report:-o (yes/no)

First thing you need to look at is the dates on your CRF.

What says there ?

You need to be asking to see a copy of the notice of assignment which should be available to you by making a request under the CCA enclosing £1 (From Hillesden)

 

Meantime you can add a notice of correction to your file.I suggest;

 

"The subject disputes the information recorded and believes it to be incorrect,am awaiting response to my complaint from Hillesden"

 

They wont like it-but it is your right-so insist it is recorded !!

 

Then you can reconcile dates.

Of course if you have some info that you think can be questioned then all well and good.

For £1 will be a good investment and while you are asking for this,ask also for a statement showing the balance of account and any fees added.

 

Ask also for a copy of their complaints procedure.

 

The CRA is likely to reply that they need to contact Hillesden and will reply to you after they get a response.

 

If you can show the CRA any proof that entries on your credit files are incorrect or should not be there,then you should put them on notice that you expect it to be corrected/removed immediately.

They are equally responsible for what appears there so dont be fobbed off.

i have made a cca request to hillsden on the 7/7/2010:)

 

had letter back (i will update you on developements in 21 days:rolleyes: if there are no developements beforehand:-?

 

basically the letter: which states they can not enforce the agreement:)

"just this letter back" (No statement of account)

 

also i have made a complaint to the CRA before i posted on this thread.

(still awaiting reply :))

 

i wont be "fobbed" of any more:) with regard to hillesdens putting a incorrect default on what should/ could happen to them.

also what should/could happen to the CRA(s) for letting them do it.

When you made your CCA request did you request the statement of account ? Its your right.

 

Hillesden should have the account documentation if they have bought the account.If not they have a responsibility to supply it.

OFT debt collection guidance (unfair business practices) cover this.

 

If they are failing to comply,then report them to your local trading standards. (But you will need to supply supporting evidence)

TS will not deal with Data protection issues they will tell you thats a matter for the ICO.

 

In the case of the CRA-if they will not take your complaint onboard,or you feel that they are not responding,you can report them to the ICO.

 

You can also file in the County Court seeking an order forcing them to comply,and / or seek compensation under section 13 if you feel you have a case.That would need to be done on an N1.
