I've Been Corresponding With A Dca Regarding An Alleged Credit Card Debt. I've Bypassed A Section 78 Request As I Went Through This With The Oc. I Have Asked Them, In Accordance With Oft Guidleines, To Confirm That They Have In Their Possession A Copy Of A Properly Executed Agreement. They Have Responded Twice Now With A Copy Of An Application Form With No Prescribed Terms And With No Original Terms And Conditions. They State That they Believe This Is Legally Enforceable And That They Are Therefore Not In Breach Of Oft Guidleines And Will Continue To Threaten Legal Proceedings.

What Can You Say To This? It's A Stalemate. They Continue Their Weekly Threats And Hide Behind The Guise That they Believe The Document Is Enforceable! They Are Well Aware That It Is Not As The Dispute Has Been Ongoing With The Oc And Subsequent Dcas For Three Years. The Oft Will Not Declare On The Enforceability, Will They? Only The Courts Will Declare.

I Thought This Was A Good Route To Follow - Forcing Them To Declare Whethre They Have An Executed Agreement - But It Has One Large Loophole: " we Believe The Document Provided Is Legally Enforceable"

as you say, it's 'stalemate'. if it is enforceable, and economically viable to pursue in court, then they would probably go for it. but they haven't, after 3 yrs! another 3 yrs, then it is SB.
