    • As advised statute barred debts are dead...if your alive or dead......so are CCJs that are over  6 years old and have never been executed or secured against property by way of a charging order.......no matter how much your estate is worth.
    • I booked several rooms with FABHOTELS.COM - I have made sure the rooms were cancellable    due to the condition in India regarding Covid becoming very bad I cancelled the rooms and my visit to India and will not be travelling for the foreseeable future, I then checked my account and they have stated there can be no refund back to my card but I have to accept their room credits to the value of £478 valid for 12 months when they will then expire if I do not use them by that date,   I have contacted them on several telephone numbers and via email, they have refused to issue a refund : stating it is their policy to issue only rooms credits and these will expire in 12 months, they have advised they have the right to do this under the contract and under Indian law,   I have raised a SEC 75 claim, via the credit card company however they have not advised what the above means and stated it will take 11 weeks for a response,   I am concerned that a refund has been provided and the cancellation has been approved as such as a refundable cancellation, albeit they have stated no refund to the credit card can be made. I have sent the following to them and their response has been - we are unable to assist further - I have now concern how they can do this when the law does not allow this to be possible? The issue that I have experienced was:   Disgraceful behaviour by Fab hotels in holding cancelled bookings in an expiring account when cancelled fully - NO REFUND ISSUED? Please can you refund the full amount to my credit card as due to the Covid restrictions there is no guarantee I will be in India in next twenty four months I await your refund back to my with the Credit card Company as I am not able to use the Credits expiring in 12 Months, I have been in touch with the credit card Company and they have confirmed they will be looking to FabHotels to refund back to the Original card as part of the Sec 75 Laws where a cancellation has been made and the payment has to be refunded back to the Original payment card. I have not been able to confirm I will be using the credits and therefore in order to safeguard my funds these needs to be back into my, If this is not accepted then I reserve the right to take the matter further for a investigation and chargeback as I have not authorised the payment and the reservations have been cancelled. Please can this be escalated to a senior manager and a refund issued back to the Visa card. If this is the Customer experience I have to endure then I will make it quite clear that this i not acceptable that you take money and put it into a expiring account and then ask me to contact you to get the extension,   this is not customer service, I am deeply distressed by your action as there are no other Booking agents who are doing this to their customers, especially considering the hotels have been accepted as cancelled and a refund issued but held in expiring account.
    • That's logical and correct DX,  and how I understood it to work if they can't pursue the debtor  for the debt whilst they are alive, it can't be resurrected and charged against the estate or demanded personally from executors who knew diddly about that SB debt..

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

If a bus driver cannot accept my money.

Basically I wanted to get on a bus but only had a £20 note which the bus driver couldn't change, I was wondering if anybody could help me with my rights in this situation.

I think the onus is on the passenger to tender the correct fare, there is no legal right to give change.

Completley correct.

 

Bus co's which still give change do it as a customer service excerise and their drivers will carry a float of around £30. Obvioiusly it only takes the first couple of passengers of his shift to tender £10 & £20 notes and then his change has gone! Could you not have changed it prior to catching the bus?

I know First Devon and Cornwall will give you a credit note if they cant change a note which you take to a travel shop to exchange for money.

I'm a bus driver and let me tell you. The amount of times i've had people coming on my bus with a £20 not for a £1 fare is ridiculas, when I worked for a Big bus company the float was £10!

 

There was a time when no bus driver would even entertain you with a £20 note (remember buses having exact change only lit up on the side of buses) now it seems a free for all and its us that gets it in the neck for not having the change, as you have proved.

 

Show some consideration to us bus drivers, ok we are not all perfect but. When I first started driving buses I had a smile on my face, that was quickly wiped from my face, think it’s fair to say we get the dregs of society on the buses and there are a lot out there who are just seeking compo as the bus companies believe everything the passenger says, we get no support off our employers at all.

 

I have posted this link to show you what we are up against, have a look at all the negative comments against this passenger who decided to take it on himself to film the bus driver against his will just for not putting the ramp down, the bus driver was very near the RAISED kerb so there was no need to use the ramp, this bus driver was sacked, but no action was taken against the passenger filming the driver against his will!

 

Please take a little time to have more consideration.

It is quite obvious that the person who filmed it is one of those 'I love going out looking for things to complain about' people. As you say, from the breif glimpse we got of the platform, the gap was very small and a wheelchair could of easily negotiated it with assisatnce.

 

I do have a couple of comments however, the driver was technically in the wrong by not using the ramp although as an ex bus driver myself, ramps and their operation have always been a hot potatoe. How are you supposed to operate one when you are not ment to leave the cab? Also, i'm sure that the bus co management would of viewd the bus on board CCTV footage of the incident as well so I am surprised that they simply 'sacked' the driver rather than give him perhaps a warning or extra training or something. I am aware that it appears that the bus driver gets very little back-up from management which deters them from doing the job properley.

Nice to here from a fellow bus driver and your comments are welcome, how long has it been since you were a bus driver? did you ever work for one of the big 3? (or is it 5 can't remember?)

 

The bigger companies tend to take the side of the passenger cause of the compansation culture we now live in, I know I was recently sacked unfairly from one of the big boys.

 

Far better to work with the indies, you at least get a hearing from the smaller independent companies. Not all customers are right and increasingly its getting to the point where passengers will "spice" there complaint up, I also know this as its happened to me and the passengers involved were proved wrong by CCTV footage, but I still got a written warning!

 

Its a totaly diferent ball game these days, and if your not driving buses any more you did the right thing by getting out.

When I first started in 1982, it was with WMPTE (West Midlands) and then in 1987 it became West Midland Travel (overnight) following bus de-regulation. Strange that the main reason for de-regulation was to remove the financial responsibility for running buses from the local authorities and turn the buses into private companies. Now we hear of the bus co's being mainly subsidised by the local authorities because of the concessionary scheme! But that's a different story. After a 5 year break working for a small coach operator and a spell in the motor trade, I went back to West Midland Travel which was by then part of National Express. I was one of a few drivers who tried to do the job 'by the book' which upset both passengers and management but never the less, I never fell foul of the disaplinary process mainly because I knew a bit about employment law which sadly to day, few bus drivers do.

 

I ended my bus driving career in 2007 with a small independant company on the south coast which had been took over by the Go-Ahead grouip in 2005. All they are interested in now is making as much money for the share holders as possible. Both passengers and employees are a secondary concern.
