    • Hi,     I'm in the process of voluntary termination of my moneybarn agreement, in accordance with secion 99(1) of the Consumer Credit Act 1974. I have returned the vehicle, it was collected by a 3rd party on behalf of MB, in driveable condition with fear wear and tear condition.  Their report states that the condition was "Average" (The options were Good, Average and Poor). I have paid more than 50% and recently, before starting the VT process spent £700 to make sure car is roadworthy (gearbox repairs). I am £880 over the 50% mark. Today I've received final billing letter estimating body repairs at over £1,300 (the bodywork is fine - peeling lacquer and alloy wheels would need refurb though). I've purchased the car at 7 years old with over 80k miles, through National Car Credit (pretty sure I've seen another topic on here about them). The car is now more than 10 years old, and I did take pictures + videos of the car before it was collected.   Now. I've had a payment holiday through April and May (which I don't dispute and will willingly cover the amount that they're asking for this payment holiday term) But however I'm not okay with covering the bodywork repairs for a car that is over 10 years old and wasn't excellent condition the day I've purchased it. It came with no service history book and only one key (on my own expense I've purchased another one and had it programmed)   No arrears on the account, no missed payments (just 2 month agreed payment holiday - between myself and MB) which I'm okay to cover. Given the car back in drive-able condition (it was very noisy the week before it was collected, hence why I've spent money on repairs) half of tank of petrol, kept tax up to the day it was collected.   Advice would be appreciated, thank you.   dx: I can't pm you as I haven't got enough posts on here, but if you'd like more details and see what has been sent and see the responses please PM me.     Thanks.
    • I am not a lawyer but I definitely think you are correct.   You will need evidence that Fast Track was not available on your way out - "Unknown reasons" sounds ominous. Do you have pictures/videos/written records to prove it?   Ryanair website states they are not responsible for you missing your flight as a result of fast track, but it doesn't say anything about not being responsible for the product they sold you not being available. Have you tried asking for a refund already?   Either way they sold you something that they did not provide - I don't see how this can be legal - and hopefully you should be able to prove it. Get written evidence that they refused to refund you (if you don't have it already) and take it straight to your card provider. (by many accounts it seems pointless to try and negotiate with Ryanair)
    • Hello everyone, recently I ordered 4 birds, 2 canaries and 2 lovebirds from a pet shop in Nottingham. When I received the birds, one of the canaries looked scruffy and had a bald spot on its back. when I asked the owner if this was normal he stated that “it is a baby and will be normal in a week” so I waited a week and I discovered it was sneezing throughout the night. I then decided to check their weight and the scruffy one was only 15 grams while the other was 26 grams. While weighing them I discovered they were covered in blood mites (small bugs that feed on blood) so I contacted him and he said I could return them but I’m unable to drive an hour to his shop so I offered to pay another delivery fee fr him to pick it up but he was ignoring me so I decided to try to treat them and bought many medicines and I cured their mute problem but now all 4 birds are sneezing, I’ve had many birds before and I’ve never had these problems so I asked him if he couldn’t please come pick them up but he kept reading my messages and ignoring me then when I called him he blocked my number so I messaged him on my other number laws showing te sale of an ill animal is prohibited and sent him proof of his false advertising (saying they were “excellent healthy birds”) proof fm their illness and he blocks me again. I feel scammed and according to the law he I is obligated to refund me for the birds and any medical expenses but I don’t know know where to report him or what to do about it. Any suggestions would  be greatly appreciated. Thank you

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

RPL asking for unfair charges under civil recovery

Introduction:

I hope you will be in the best of your health. I am very happy to find out this forum and feeling very comfortable to release all stress provided to us by RLP+Tesco. My names is xxxxx and I am writing to you on behalf of my wife, please give us some advice or letter to support ourselves in these tough circumstances.

 

Incident:

We went to the Tesco store in a quite good mood on 08 June 2010 (it was our first visit to that store), and paid for the shopping at 18.51 (we got the receipt). I and my wife were shopping in different isles and our baby was with her as well. She put 3 items with her so that she can give it to me for the payment (no intention of shoplifting at all). In our circumstances, baby got hungry and was starting crying. my wife is quite emotional in sense of baby as she got two miscarriages in the recent years and never left baby alone or crying. So she went to external patio of the Tesco so that she can feed baby. However, I paid £ 23.05 for the rest of shopping and unfortunately I met her after payment and she didn’t get any chance to tell me that she needed to pay 3 more items.

The security guard was following us on the CCTV and personally and came in the external patio and asked for things and recovered. We explained this situation to him honestly and apologized and offer to pay. He didn’t listen to us at all and took us in the security office. Because of baby, (was crying at that time), they offered me to come with her just to support baby. My wife was disturbed very much by the situation and she started crying so I have to go with them. We got two more Tesco staff there and I explained the situation again, but they blindly supported their security guard and called the police. They told us about civil recovery (we never come across and don’t know what it is?) and compelled my wife to sign it without understanding it.

It’s not finished here, they said it’s too late and we are calling police and you have to stay here until policeman comes and we have to stay there for about an hour unlawful detention. We were also disturbed because of our baby who was keep crying and weeping all the time. But who cares? It was looking that there is no law and they could get any thing from us as they are more and in power and forcing us to do this and that.

Anyway policeman (PC) came and took us out from that scary environment. PC handles us quite gently honestly and on merit, and I explained all circumstances to him that this was a mistake happened due to disturbance caused by our baby and emotional attachment with the baby. PC said, "Every shop lifter presents similar excuses, however, CCTV is and excellent equipment to justify" I agreed with him. He took all of our details and let us go, and promised that he will watch CCTV and decide what will be further action depending on the CCTV. We come back home after and panic 4 hours wastage of time there and very exhausted. We were very disturbed and specially my wife could not sleep that night and obviously baby care was disturbed very much and I have to play role between my wife and baby and was very late from uni next day.

Until the next day, I did not hear from police, and then I called back, and explained the situation of my wife to them that she was very disturbed and I remained unable to calm her. PC listens to me and promised to contact me soon. Later on, on the same day (about 10 pm), I got a call back from the same PC, and he explained to me that I have watched the CCTV carefully, and PC said to me that I was a genuine mistake and you forget to pay so he is not going to register any case or any thing and there would not be any criminal record, he also assured us nothing to worry and careful for the next time and he warned us that you may/may not get a letter about civil recovery and advised to discuss with you solicitor. I thanked the PC for his great humanity and assurance.

RPL involvement:

Five weeks after this incidence, my wife got a letter in her name form RPL, demanding for 137.5 pounds (or 110 if to pay now). My wife became stressed and panic again as she is jobless and full time on baby care and I do support them to some extent for life necessities. She is very disturbed and not willing to even visit GP as she is not willing to disclose about this incidence to anyone. Even I am writing to you with her consent. so I called to RPL and explained them every thing. RPL said you have to pay or write a letter to us explaining your circumstances and give us a letter from her GP also that she had two miscarriages in the past (then we may consider removing charges or getting in instalments). I went to GP to get this letter, the GP replied that they need to know details why you need this kind of letter and will charge £20.00 to give such kind of personal letters. My wife didn’t consent to provide details to GP or pass her medical record to RPL.

Questions in our mind:

1-do I need to pay these charges or are these justified?

2-what could be the extreme prospects for not paying, have they got any grounds?

3-what should I do? Write a letter? Or ignore them; I don’t want them to keep my data

Legal questions:

1-who is responsible for keeping us for unlawful and forceful detention in TESCO security office, and scaring us and our baby and compelling us to wait for police.

2-No informed consent for civil recovery was taken, how come they bullied the lady to sign (even she doesn’t understand English)

3-how they can process and forward my personal details to a third party (RPL) without my consent, is it compatible with data protection act?

4-who are responsible for giving us tough time, stress, tension, anxiety, insult for a tiny tiny mistake?

5-donot we have as equal rights as these big companies to claim compensation for the disturbance they provided to ruin over peace for 6 weeks and shattering our confidence to face? are their business more valuable then human being or their lives? they dont care, does not matter if bay is crying or you are getting nervaous breakdown because of them.

6-why RPL has the right to get and hold on our data as there is no criminal action.

7-who can blame (sue actually) to stamping us that "COMMITING A WRONGFUL ACT". As it has been proven and can be proven again that all incident was a genuine mistake and mistakes and human nature and they had no right to call human nature a wrongful act. (But they can say and suppress with any thing as they are legal company and we are helpless lay persons)

8- Who is responsible for igniting the stressful condition in my wife, which I calmed down over the period of time?

No RPL is there to work for me and to get me compensation from TESCO for all these issues, because I am a common, poor individual with much less rights than these giants.

From the forum Blog, i know that I don’t need to pay them any thing, however I need your advice and guidance to assist me and handle them properly. Moreover, I would like to get money from them for the compensation of all damages they caused me and my family. I know neither TESCO not RPL with own the responsibility for that.

I do apologise for taking so long as I was hurt so much because of this incident. I am very thankful to you all for your time taken to go through this matter and helpful advice.

hope you find the answers you are looking for...i have found this site a bit cloak + dagger,i was advised to pay it lol.i am doing my best to fight this myself!not had alot of help off here really,if you look through other threads there is no ending to them so you don t no what to expect or what to do..hope you have better luck than me + my wife:(

Its with regret that you dont have much faith in our forum to help you Maximas.

Your own case is relatively recent,and you have been advised to do nothing for the moment.

Its my understanding that so far there has been nothing to suggest any threats against you are real ?

We do not believe their fees /charges are in proportion to their claims that they represent a true pre estimate of their interventions.

We have seen the same fees demanded for almost all cases irrespective of what took place,where,time involved,value of purpoted loss etc etc.

We are of the view that these fees/charges are a fixed penalty.

3-what should I do? Write a letter? Or ignore them; I don’t want them to keep my data

Although the previous poster in your thread suggests that there are some unresolved cases here-it needs to be pointed out that lots cof work has,and continues to be going on behind the scenes,because we are aware that RLP have been monitoring these forums and continue to do so.

That is made clear by RLP themselves. If this was a true estimate, then they wouldn't be able to offer a reduced payments if paid before a certain time.
