    • Can you ask your GP to get a second opinion on the NHS?  (I ought to know because I'm a retired NHS manager, but worked in mental health where x-rays didn't really feature very much(!).)   Your GP may be reluctant for various reasons but you've got nothing to lose by asking.  Might be difficult if there's only one consultant in that specialty locally.   If that is a non-starter, you could ask your GP for a private referral if any of the relevant specialists run private clinics.  Your son'll get seen quicker and an initial private consultation shouldn't cost more than about a couple of hundred quid.  Then take it from there.   (Emphasise to your GP what your real concerns are and why you have them - even if it's just "I looked it up on the internet and it looks like this which can lead to serious complications.  What do you think?  I'm really worried...")   EDIT:  Just looked on my local NHS Clinical Commissioning Group website and searched for "second opinion" but nothing comes up...  I thought you were entitled to one - you'll have to ask your GP.  Or look on your own CCG site.  Oh - despite being a NHS manager I have paid to see a consultant privately.  £150 well spent - if you can afford it... which I appreciate not everyone can.
    • dont think they are even allowed to offer settlement by instalments, they are not creditors.   read the letter carefully and understand what it doesn't actually say....like the word WILL anywhere.   they,  a DCA, can't recommend anything and their client most certainly wouldn't have disclosed anything to a powerless DCA about what their solicitors might or might not have said to them. and ofcourse a solicitor is in no position whatsoever to suggest to their client they get back to the DCA and tell the DCA to tell you their client will accept instalments!   the letter is a load of ole BS that is concocted by the dca without any input or knowledge of their client nor their clients solicitor...   dx      
    • The paediatric orthopaedic consultant at the fracture clinic told us today that he believes it is just a sprain behind the knee. I'm concerned my GP will say something along the lines of, 'you have seen a consultant, he says it will heal in 2 to 3 weeks, you don't know more than him!', or something like that. It's just that I believe I can clearly see a fracture. And as there was no fall or hard knock, only a very tightly streched knee bending at an angle behind, with a load. I figured that the temdon must have pulled some bone up. And thats the injury I found online. I totally take on board what you are saying. You are correct. I guess I'll see what my GP says tomorrow, hopefully she allows me to email the images, if she doesent have access to them already. Thanks again

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

good morning all !

looking for a follow up on some advice :)

 

i had a visit from a bailiff last thursday and he issued me a notice to remove goods, i have been paying my council tax every month and missed last month payment ! I owe 373.00 on my rossendales account and he issued me a notice to pay of £ 559.00

 

i tool the advice from some of you guys on her and have sent a letter by recored delivery asking for a complete breakdown and a screen shot so i can see what charges have been applied, NOW my worry is that the bailiff gave me 7 days to come u with the money of £ 559.00, what i NEED to know now is what do i do ?? when he comes back ?? he gave me a notice to remove goods but has not put any levy on any cars etc and i dont want to pay 559.00 but these bailiffs can be NASTY AND I AM WORRIED ABOUT IT CAN SOMEONE PLEASE ADVISE WHAT MY RIGHTS ARE REGARDING HIS RETURN AND WHAT I NEED TO DO ? also WHAT ARE HIS RIGHT CONCERNING THAT I HAVE PUT THIS LETTER IN GIVING THEM 14 DAYS TO REPLY YO ME

Who says you owe £373, the Bailiff or the Council. You need to ring the Council and ask them how the Liability Order was for and how much is still outstanding.

 

If the Bailiff is claiming you now owe £559 then that sounds very much as if he has charged his 2 visit fees, a levy fee and an attendance to remove goods fee (van fee). What paperwork has he left. On each visit a letter should have been left and if he has levied on any goods on a different visit then he should also have left you a Notice of seizure.

 

Has he been inside your home? If not then whatever happens now do NOT let him in. If necessary conduct all proceedings through the letterbox or from an upstairs window - if you can record any conversation. Do NOT ring him unless absolutely necessary. He will make lots of threats and insinuations none of which he can carry out.

 

You do need to establish how the debt has soared though.

i had a letter from rossendales dated 22/2/10 total amount due to pay to them 865.81

i set up an arrangement to pay £ 163.95 and have paid every month until last month 1st payment made to them march 2010so if you take off whati have paid from the 865.81 i have £ 373.96 left to pay, however because i missed the last payment of 163.95 they have not telephoned me or written to me they just sent a bailiff to my home address he knocked and left letter in letter box so i went out to his van and spoke with him, i explained that i had paid every month and he said well i need the balance in full - now showing on bailiff removal letter of 559.96p i asked him how long i had to pay and he said that as we had spoken he would give me a week 7 days to pay and to call him on his mobile to arrange to come bac and pick up the full balance, no he has not been in my home or levy on any cars as there were none at home.

 

have tried ringing council - all operators busy call back later !!!

have just spoken to council total lialbility order sent over to rossendales was for £ 739.81p

 

and i have paid off that amount £ 163.95 in march april may so total amount due with no charges would be 247.96 and the bailiff letter states 559.59p to be paid with in 7 days the council staed that i have 373.96 left on my account to pay to rossendales which as we now know is 559.59 what should i do ?

dont pay the bailiff direct pay the council via internet banking on the back of the ctax bill

 

ask the bailiff co for a screenshot.

 

read one of the many threads here for the format of the letter.

It appears to me that the Bailiff is screwing you for his fee. How long ago did you ask for Breakdown and have you checked Royal Mail Track & Trace to make sure your letter has been received - did you also send a copy via email.

 

In the meantime do not allow him in regardless of what he says and do as dx100 says and pay online in the meantime. Your payment is accepted but make sure you pay an affordable amount on a regular basis.

i sent the letter recorded delivery yesterday to rossendales, have not emailed it as can not find email address for rossendales, shall i pay £ 50.00 to the council today ? and then pay £ 25.00 per week from now on unil i have paid the 276. or the 373. ???

If only sent yesterday you will have to wait first but if someone does turn up just ignore them - easier said than done I know but you have to learn to be hard nosed about it. I can't tell you how much to pay but what you have listed is more than reasonable to me. By the time you get to the total amounts payable you should have a reply to your request by then.

if i am out or dont answer the door and the bailiff calls wont that then incur more charges ?? and wont he keep coming back ??

should i send an email to rossendales informing them that i do not intend to acknowlege him and that i am in dispute re the amount and only until i get the correct info and charges that i will pay and that i will pay direct to the council ??

help please -

 

re my recent posts just had a tel call from bailiff and quoted to him my rights he was rude and nasty and told me he would gain entry to my home and remove goods i told him that he could not enter my house i told him he could not step on my drive as this is trespasing ! i would call police i told hm i was not paying the charge of 186.00 for his visit and i would pay my 373.96 direct to the council, he told me he has more powers than a county court bailiff and that he can do what he wants to exercuite the warrant for the libability order issued at the magistraes court - he then said he would give me another 24 hours - i told him i would not be paying him and to do what he likes, he said that he could arresst me for not paying, i told him that this is a civil matter and he states it is criminal case ? i told him he could not arrest me he again said he has more power than anybody to do what he wants. he then said he was going to my house now, i told him we were out. i parked my car down the road and walked to my house he was sat outside in his van, i completly ignored him and came in the house and locked the doors, i have telephoned rossendales and tried to make a complaint however all complaints need to be put in writing, he sat out there for a good 15 mins and left, he has left no letter or anything in the post box, i spoke a girl at rossendales who was no help and then asked to speak to a manager whom had all finished for the day, she has requested that i get a call back tomorrow from a manager from 8.00 am - 6.00pm and that there is nothing she can do - he has said he is coming back in the morning - what shall i do ????

please help !!!!

basically the bailifff is there to threaten you and use all the tricks in the book to try and fleece you.

 

PUT THE PHONE DOWN...simple.

 

all above is a load of rollocks

 

ignore them

 

phone the council 1st thing they are responsible for the actions of the bailiffs they employ.

For starters make sure there is no cars or anything in his view so he can not levy on them 2nd ignore him either go to uptairs window inform him you are not letting him in and that you will pay the council balance t the council and that you are refusing to pay any unlawful charges and then ask him to leave your property there is nothing he can do will be so much better if you can video it to that will make him feel uncomfortable and chance are he will run with his tail between his legs you do not have to let him in and the last thing you want to be doing is leaving windows and doors open as they can gain entry peacefully via a open window or door so never open one to them also do not bother ringing them unless you can record the call keep it all in letters and keep your own copy i would also if you see him sitting out there again contact the police tell him you are been harassed and feel extreamly intimidated they wil have to move him on to which that will annoy him :) the bailiff has no power what so ever keep in contact with the council via letter to every time you make a payment do a letter of the amount you have paid and what your remaining balance is also keeping a copy for yourself that way you keep yourself right and it looks as though you are trying

guys thank you so much for your help and advice, am going to pay the full outstanding amount to the council of 373.96 tomorrow i do hve a problem our garage door is broken can he gain entry though there as it leads into my house and is not secure, can he out a levy on my husbands car ? even though the debt is in my name only !!!! i will get the video recorder out and video him, what the hell is the matter with these arse***** they make me feel sick, surley there has got to be a way to stop their behaviour and for gods sake what is wrong with the councils emloying arse***** like this we should write to who about complaining about their ways and the way they add unreasonable charges and put a stop to all this once and for all

yes your bailiff can enter your home through the garage and he can levy your husbands car(unless its on HP) council tax is a joint debt

try to secure the garage door if you can and get the debt paid before he has the chance to levy

I would pay half this week and half next week if it will leave you short and unfortunatley most councils do not accept these animals are doing wrong as i am finding out myself even been assaulted by one of the bailiffs from rossendals hasnt made them wake up and see what animals they actually are stick to your guns and you will win your fight :)

good morning guys - update result !!:p

 

i paid the full amount of 373.96 direct to the council and payment accepted, i have also made a full complaint to the cheif exective of the council, i have also sent COPY complaint to local MP and have threatened to contact local papers. NOW I WONDER IF THE BAILIFF WILL RETURN TODAY ?? I HOPE SO JUST SO THAT I CAN HAND HIM A COPY OF THE EMAIL FROM THE COUNCIL - Imforming him that all action has been HALTED !!! Wonder if rossendale's will inform him of there contact with the coucil this morning and i wonder if i still get the call request from the manger at rossendal's ?? - i bet i dont see or hear from them !

I have received an email this morning from the cheif of services monitoring manger, halting all bailiff action so that the complaint may be dealt with i have posted below copy of the complaint made to them - i am also going to post it as new thread i think THAT everybody who has dealings with rossendales should make a complaint and make it stiff - if EVERYBODY complains then SURELY SOMETHING HAS TO BE DONE !!

I am writing regarding my council tax bill that you passed onto Rossendale’s I am wanting to make a formal complaint about the sub contractors that you use regarding collecting council tax, I understand that your responabile for there actions in which they apply to residents on collecting debts 1) there charges are unlawful and excessive charging £ 186.00 for a visit - how can this be justified? 2) the bailiff told me he would gain entry into my home and remove goods he sat outside my house trying to intimidate me and my children 3) he telephoned me making various threats of what powers he has according to him he has more power than any other bailiff and that he would attend and arrest me for non payment. I have yesterday paid my 373.96 that was outstanding on my account even though I have a bill from Rossendale’s dated 17 the July for 559.59p I have informed Rossendale’s that I am paying you the outstanding amount direct which I have and I will not be paying any charges that are unlawful and excessive 4) I am a diabetic type 1 and with this life threaten illness am under the national standards act classed as vulnerable. 5) I have made a complaint to Rossendale’s asking for a breakdown and a screen shoot which by law I am entitled to receive if requested in the correct manor 6) I can not believe that you our local council as willing to let Weston super mare residents be bullied and threatened by these companies and surely this behaviour infringes on our human rights, all the above behaviour was because I missed one payment on my Rossendale’s a/c due to illness, I have been very upset and very frightened by all this behaviour including my children have been frightened to death by all this and I wish to make this a formal complaint to you the north Somerset council for using such unlawful bailiff agency company - shame on you for allowing this behaviour to be allowed, I suggest that someone in authority takes a look at the consumer action group on the internet to read the threads on Rossendale’s and has a look at what behaviour is really taking place between the bailiffs and residents who owe council tax, - I am sure you would think twice before passing any further accounts to this group of bullies who threaten and frighten old, young and vurunable people I will also be writing to my local mp regarding this matter and the local papers surely in the current climate the last thing people need are companies trying to exploit money by illegal right

What would you like us to do to put things right :

I would like an explanation from yourselves on what homework you do regarding you sub contractors that you employ and how you feel that there charges are justified and if you take a look at the guidelines set out for bailiff charges you will see that the company you are using are [causing problems] people left right and centre to obtain illegal fees I suggest that you telephone Rossendale’s straight away and advise that payment in full has been made to yourselves direct and that you make an enquires re the charges applied to my account and also ask for a breakdown of the charges that they apply to council tax bills, there are laws and procedures to be followed to if you read the consumer action group these bailiffs are doing just as they please, I have advised the bailiff that called at my house that if he tried to gain access I would call the police straight away as it would not be gained by peaceful entry - this behaviour is not acceptable by any means - this behaviour is not acceptable by any means I will await your urgent response

if you have stuff from outlook or word you'll see when you copy and paste as your above

you get the control chrs# for fonts and layout etc showing

and it also puts everythign in one 'lump'

 

making it crap to read.

 

copy and paste what you want to notepad first

 

get it looking ok

then copy and paste you notepad text to the msg box here
